STAFF REPORT Special Joint Workshop for Discussion of Recommendations for the Update of the Metropolitan Bakersfield General Plan Ted James – Director Kern County Planning Department Jim Eggert – Director City of Bakersfield Planning Department March 8, 2010 The purpose of this evening’s workshop is to discuss specific issues with stakeholders regarding the development of the Metropolitan Bakersfield General Plan Update. Specifically, this workshop will focus on: 1) proposed alternative boundaries and/or methodologies for the proposed Urban Opportunities Concept Map; 2) infill incentive strategies and a review of concepts to promote more compact development; and 3) general public comments on other issues concerning the Update. The results of this workshop will be provided to the Board of Supervisors and utilized in developing new or modified policies and implementation measures in the Draft General Plan Update currently being developed. The Joint Planning Commission workshop will focus on specific discussion and input on the following questions: 1. How should the areas for planning future urban growth be determined? 2. What is considered infill? General public opinions may differ from developer opinions. 3. What would developers need as incentives to encourage infill? What types of amenities does the general community want in the infill areas? 4. What other issues or concepts have not been discussed that are important for the update? CONCEPTS TO PROVIDE GUIDANCE IN DETERMINING THE STRUCTURE OF THE PLAN AREA • Allow the current practice -General Plan amendments and building anywhere in the plan. • Establish a specific growth boundary to 2035, with an interim evaluation in 2020 of growth patterns and unanticipated needs. • Establish a graduated opportunity boundary: 􀂃 Past identified limit lines, a selected percentage of the adjacent area must be developed and connected to urban services before additional areas can be approved. • Establish a planned opportunity boundary: 􀂃 Past identified limit lines, a selected percentage of the adjacent area must have approved designations for urban development but does not have to be developed or connected to urban services. • No boundary lines for areas of development within the plan area – instead, use a framework of strategies, standards and policy direction for requirements to resolve land use conflicts. Joint Planning Commission Workshop March 8, 2010 Page 2 of 4 FOCUSED INFILL AND INCENTIVES Infill is a term primarily associated with development within an incorporated city. This has been reinforced by the CEQA guidelines, which has an exemption for infill projects within city limits but none for unincorporated areas. In the incorporated area, the City has existing redevelopment areas to encourage new investment and mixed use. The City will continue with efforts to use redevelopment strategies to promote infill opportunities. The updated Plan will also encourage use of the concepts shown in the attached "Tool Box" of Infill and Fringe Area Strategies. In the unincorporated area, Staff is proposing to identify appropriate areas and establish focused infill promotion areas. Possible areas for consideration of these promotion areas include Oildale, Lamont, East Bakersfield, Western Rosedale and the Airport Economic Opportunity Area. The following are preliminary concepts for the implementation of the Focused Infill Promotion Area: • CEQA Streamlining -The size and location of areas will be identified in coordination with the City. Densities and types of uses will be created and an analysis will be included in the EIR for the General Plan Update at a level that can be used to implement a tract map or Precise Development Plan. • Create standard templates containing design direction for projects that includes enhanced standards such as density and parking. Include park provisions, design and mixed use guidelines centered on already identified commercial areas, buffer concepts for surrounding large lot development, and identify incompatible land use conflicts (already existing industrial for example). • Allow possible variation to Level of Service standards that manage for peak traffic only in selected areas. Instead, use trips or connectivity standards. • Explore other concepts shown in the attached "Tool Box" of Infill and Fringe Area Strategies. BACKGROUND INFORMATION Current Metropolitan Bakersfield Planning Boundary and Issues: The boundary of the current Metropolitan Bakersfield General Plan was established at 408 square miles in 1990. The incorporated limits of the City of Bakersfield are approximately 140 square miles and their existing Sphere of Influence is an additional 112 square miles within the General Plan area. The unincorporated Western Rosedale Specific Plan area was approximately 57 square miles (36,555) acres when originally adopted, but has since been reduced by annexations into the City of Bakersfield. Past practice has allowed development to occur anywhere within the plan area, usually based on available infrastructure and the proximity of similar Land Use designations. However, past policies that allowed development on septic systems has created islands of large lot rural residential in the southern and western portions of the plan. The extent of urban development patterns and vacant parcels has been provided on the attached “Undeveloped Parcels Map as of 10/1/2009”. Previously Proposed General Plan Update Planning Areas: On April 20, 2009 the County/City Planning Team conducted a Joint Planning Commission Workshop on the progress of the Update of the Metropolitan Bakersfield General Plan including the presentation of preliminary maps and concepts for establishing new planning areas to manage transportation and growth issues. In addition, observations from the Existing Conditions Report were presented at the Joint Planning Commission workshop: • The existing plan focus has been directed to growth on the periphery rather than infill or densification Joint Planning Commission Workshop March 8, 2010 Page 3 of 4 • The current “centers” concept is not well-defined • Current planned growth is not transit-friendly • Existing development patterns place a greater focus on urbanization than agricultural conservation • The Metropolitan Area Transportation Fee Program is constrained in that it does not serve the entire General Plan Area. The Draft Urban Opportunities and Reserve map that was presented at the Joint Workshop showed five areas summarized on the attached “Urban Opportunities and Reserve Map”. 1. 2035 Build-out Area 2. Rural Neighborhood Clusters As a result of public input, the original names of these areas have been modified and are now identified on the revised “Urban Opportunities Concept Map – Revision 2” as follows: 1. Urban Area 2. Urban Reserve 3. Future Planning Area 4. Rural Community Area (Lamont) 5. Rural Neighborhood Clusters The boundaries of these areas were based based on the existing urban general plan designations, planned infrastructure for sewer and water, promotion of transit, inventory of existing and approved lots, and the planned transportation system. The boundaries included already approved City of Bakersfield projects particularly in the southern area near Taft highway. The Rural Community Area and Rural Neighborhood Clusters designations were based on direction provided by the Board of Supervisors to accommodate limited growth on septic in these already established areas, and to address growth in Lamont. In recent years, prior to the economic recession, substantial urban residential projects have been approved in the City and unincorporated areas within Metropolitan Bakersfield as noted below: Single Family Lots (approved and pending Tract Maps) City of Bakersfield 33,828 Kern County 3,842 Total 37,664 Climate Change and Air Quality Legislation Affecting Local Government General Plan Updates: During the past few years, the State has passed two significant bills intended to address climate change by reducing greenhouse gas (GhG) emissions. In 2006, the legislature passed AB 32 (The Global Warming Solutions Act of 2006) which requires the State to reduce GhG emissions to 1990 levels by 2020. This legislation set the stage for the recent passage of Senate Bill 375 which builds upon AB 32 by linking planning for land use, transportation, housing and jobs in ways designed to reduce GhG. The primary focus of this new law is to reduce GhG emissions by curbing sprawl and lowering vehicle miles traveled. Joint Planning Commission Workshop March 8, 2010 Page 4 of 4 SB 375 has three goals: 1) Use regional transportation planning and the distribution of transportation funds to help achieve a reduction in vehicle miles traveled; 2) Use CEQA streamlining as an incentive to encourage the compact location and promotion of higher density residential projects; and 3) Coordinate the regional housing needs allocation process with regional transportation planning within the context of achieving a reduction in vehicle miles traveled. SB 375 will be implemented through Kern COG which, as the regional transportation agency, is responsible for preparing the Regional Transportation Plan (RTP) that provides the basis for allocating funding for transportation projects in the County and cities. The SB 375 legislation will utilize Greenhouse Gas reduction goals in conjunction with the awarding of transportation funding to local governments as the means to change land use patterns (reduce sprawl) to achieve a reduction in vehicle miles traveled. The active involvement of the State Attorney General's office in reviewing local government updates of General Plans has also caused cities and counties throughout the State to ensure that their general planning programs include: • Higher density development that focuses growth within existing urban area; • Policies and programs to facilitate and increase biking, walking and public transportation and reduce vehicle miles traveled; • The creation of “complete neighborhoods” where local services, schools and parks are within walking distance of residences; • Incentives for mixed-use development; • In rural communities, creation of regional service centers and alternative communication methods to reduce vehicle miles traveled; • Energy efficiency and renewable energy financing; • Policies for preservation of agricultural land serving carbon sinks; and • Requirements and ordinances that mandate energy and water conservation and green building practices. AB 170 requires cities and counties in the San Joaquin Valley to include data, analysis, comprehensive goals, policies and feasible implementation strategies to improve air quality within their General Plans. Specifically, the law requires that general plan programs address the air quality effects of land use and transportation plans, incorporate congestion and vehicle trip reduction measures and promote multi-modal transportation systems. These air quality and GhG laws place a greater emphasis on local governments to ensure that programs to update General Plans include active programs to address air quality and Greenhouse Gas reduction strategies. land use designations and entitlements • Contains over 52,000 acres of undeveloped land • Transportation and other public infrastructure is designed for anticipated growth • Promote/incentivize for infill and redevelopment opportunities • Primary area for mixed-use, transit oriented, higher density and/or compact forms of development Urban Reserve – Light Green: • Area within current Sphere of Influence (SOI) • Long-range planning underway to ensure adequate public services • Contains over 55,000 acres of undeveloped land • Land predominately agricultural use and under Williamson Act contract (cancellations will be discouraged) • Lands not anticipated for development for at least 10 years (if under WA contract) • Development may proceed, but with additional requirements and major infrastructure improvements that connect to the the existing urban structure Future Planning Area – Dark Green: • Areas of special interest due to proximity of urban uses and urban growth • Contains nearly 30,000 acres that is mostly resource areas (ie. water bank , petroleum extraction, habitat preservation) • Continue long-term agricultural and petroleum production • May require encroaching urbanization to provide buffers • Discourage incompatible uses to nearby urban uses
