HomeMy WebLinkAbout09/06/2013 OFFICE OF THE CITY MANAGER MEMORANDUM September 6, 2013 TO: Honorable Mayor and City Council FROM: Alan Tandy, City Manager AT/al SUBJECT: General Information Good News  All of our firefighting personnel and medical unit leaders who had worked alongside various other municipal, county and state forces to fight the Rim Fire have returned safely home. We extend our sincere gratitude for their efforts.  The Kings County Superior Court overruled the demurrer filed by the County of Kern to our lawsuit for breach of contract/declaratory relief action involving the Fire JPA. This was an attempt by the County to have our case thrown out on grounds that the terms of the JPA contradicted the allegations in our complaint. The Court disagreed; and in a thoroughly written tentative decision, which became the Order of the Court, indicated that contract terms can be “explained or supplemented by evidence of course of dealing and course of performance”. Our lawsuit is moving forward! Miscellaneous News  The Oversight Board met today. They voted to support the City Council’s position on the reinstatement of the loans made from the Motor Pool and Risk Management. In theory, this was the last step in the process to get the loans reinstated.  Reminder: All spray parks are now open on weekends only, from Noon to 7:00 p.m. This schedule will last through the end of September.  I will be out of the office next Thursday and Friday, September 12th and 13th. Rhonda Smiley will be in charge in my absence, and she and the rest of the staff in my office will be able to reach me, if need be.
