HomeMy WebLinkAboutRES NO 112-13RESOLUTION NO. 112-13 A RESOLUTION DISPENSING WITH BIDDING PROCEDURES DUE TO URGENT NECESSITY TO OPERATE THE ANIMAL SHELTER WHEREAS, City is the owner of real property located at 201 South Mount Vernon Avenue, Bakersfield, California (the "Facility "); and WHEREAS, the City of Bakersfield and Kern County entered into Agreement no. 12 -113 ( "Shelter Agreement ") to provide joint animal sheltering services at the Facility through June 30, 2013, which was later extended to September 30, 2013; and WHEREAS, due to the expiration of the Shelter Agreement on September 30, 2013 and the City's desire to provide a higher level of care and service at the Facility, City has decided to pursue operating its own animal shelter at the Facility; and WHEREAS, immediate investment in the Facility is necessary to improve the well -being of sheltered animals, create a more user - friendly environment for the public, and implement City Council's direction given to staff on July 17, 2013 to become operational as a stand -alone City animal shelter; and WHEREAS, in order to properly operate an animal shelter at the Facility, the City Manager or his designee needs the authority to contract for necessary work, supplies, equipment, or materials including but not limited to a phone system, freezer, computer software and networking equipment, copiers and printers, services for sealing kennel facilities, and a pre- fabricated administrative building ( "Shelter Goods and Services "); and WHEREAS, given the necessity of being prepared to operate the animal shelter at the Facility in such a short amount of time, City needs to temporarily dispense with bidding requirements to contract for Shelter Goods and Services. The above recitals are true and correct and are incorporated herein by reference. 2. Based on the facts included in the above recitals, the Shelter Goods and Services are of urgent necessity for the preservation of life, health or property, thereby allowing the temporary dispensing of bidding requirements as set forth in Section 136 of the City Charter and Section 3.20.060 of the Bakersfield Municipal Code. 3. The Finance Director is authorized to dispense with bidding in accordance with Section 3.20.060 of the Bakersfield Municipal Code. 4.
