SUBJECT: General Information
TRIP Reports
• The contractor for Phase 6C of the Westside Parkway is working in many
areas along the 2-mile long construction site from Allen Road to Heath
Road/Stockdale Highway. Sound walls are being constructed near Renfro
Road and Heath Road; a box culvert structure, which will allow the
Rosedale Rio Bravo Water Storage District canal to cross beneath the future
freeway, is being constructed just to the west of Allen Road; and installation
of storm drainage facilities and earthwork is occurring along most of the
alignment. Work on the Renfro Road bridge should start later this month
after the installation of a new water line (which will replace an existing
water line in Renfro Road which conflicts with the new bridge construction)
is completed.
• Work has begun on the SR-178/Morning Drive interchange project. The
contractor is excavating a large drainage basin for the project at the
southwest corner of SR-178 and Bedford Green Drive. They are also working
in the area along the south side of SR-178 between Bedford Green and the
future Morning Drive alignment installing several storm drain systems and
preparing the area to receive fill dirt. They will be working in this area over
the next several months as dirt is moved from the Morning Drive area east in
order to build up the embankment for the future eastbound lanes for the SR-178 freeway.
Recent pictures of both Morning Drive and Phase 6C of the Westside
Parkway projects are enclosed.
• Mark your calendars for the groundbreaking ceremony for the State Route
58 Gap Closure Project. This event will take place on Wednesday, October
23rd at 11:00 a.m. in the parking lot of St. John Missionary Baptist Church.

This much-needed project will widen State Route 58 from four to six lanes
between Cottonwood Road and State Route 99. City Council Referrals

This year’s Good Neighbor Festival is slated for Saturday, October 12th, from
11:00 a.m. – 2:00 p.m. at Martin Luther King, Jr. Park, 1000 South Owens Street.
This is a family-friendly event that is FREE to the public, and it will include
entertainment, children's activities, a resource and health fair, and food
booths.
Everyone is invited to attend Public Safety Day at Beach Park on Saturday,
October 19th from 10:00 a.m. – 2:00 p.m. This event is sponsored by the
Bakersfield Police Department, and is FREE to the public. There will be public
safety demonstrations from first responders, public safety information,
community-wide vendors, games and food. This event will provide an
educational and entertaining look at public safety services in Kern County.

SUBJECT: Council Referral item #424 – Debt Capacity Impact
Referral – Councilmember Johnson requested that staff look at how the debt capacity
would be impacted if the City bonded for the full $270 million local match for the
Centennial Corridor?
Response – The concept of “debt capacity” generally refers to the legal debt
limitations imposed on local jurisdictions by the California Constitution. In general,
California State Law imposes two criteria regarding the issuance of debt.
The first general rule is that the California Government Code limits a City’s ability to
issue “general obligation” debt to an amount equal to 3.75% of our assessed property
valuation. According to the County of Kern our total net taxable assessed valuation is
$21,726,716,368. This figure multiplied by 3.75% equals $814,751,863. So if the City were
to issue General Obligation Bonds we would be limited to roughly $814 million. The
City of Bakersfield does not have any General Obligations Bonds outstanding, so the
$814 million figure is both our legal debt limit and our available debt limit.
The second rule is that the California Constitution prohibits cities (including charter
cities) from entering into indebtedness or liability unless the local agency first obtains
two-thirds voter approval for the obligation.
These two rules have two important exceptions, which are the Lease Exception and
the Special Fund Doctrine. These two exceptions have been explained previously
during Council workshops and meetings, but in review they are both exceptions to the
voter approval requirement, which allows cities to enter into long term indebtedness
under these specific borrowing structures. Further, any debt issued under either of the
exceptions is not applied against the legal debt limit of the local agency.
So, if the City bonded for the full $270 million using either the Lease Exception or the
Special Fund Doctrine (currently in the validation process), there would be no legal
impact to the City’s legal debt limit.
Clearly there is a big difference between a City’s legal debt capacity and the
measurement of a City’s “debt affordability”. Just because we can legally borrow a
certain sum of money doesn’t mean anyone might actually lend us that amount. The
affordability of any debt structure is evaluated diligently by several groups involved in
the transaction. Bond holders, rating agencies, underwriters, and related legal
counsel all weigh in on a City’s ability to repay the proposed borrowing.
In the case of a General Obligation Bond they would all look closely at the City’s
General Fund revenues and our historic budgeting practices. In the case of a revenue
bond measure they would look closely at the historic and future revenue streams
being pledged to repay the debt and the legal “nexus” between the revenue streams
and the purpose of the borrowing. In the case of a Lease Exception borrowing they
would look at the valuation of the assets being pledged as security to the lease
payments.
So, in the specific case of the Thomas Roads projects and the $270 million, we are
pursuing legal validation of the Special Funds concept with the courts and we are also
considering the Lease Exception structure as needed to fully fund the projects as the
City Council directs in the future. At this point in time we have no guarantee that the
TIFIA Loan or any other borrowing will be approved in any amount, but we are taking
the steps necessary to position the City for a successful transaction (or series of
transactions) when or if the Council directs us to pursue a borrowing.

Concrete work on various streets in the area south of E. California Ave and west of MLK Blvd in preparation for street reconstruction / resurfacing (HUD funded area)
Remove & Replace concrete driveways at Fire Stations 1 & 2
Parking lot improvements at Animal Shelter
NOTE: If raining, there will be no street sweeping service and all street cleaning personnel will be assigned to cleaning plugged drains and part circle culverts. This also applies when a large number of street sweeper are in Fleet for repairs. Areas that have been missed during this time will be swept at the
end of the month.
