Perry - Public At -Large Advisory Member James Buchanan - Public At -Large Advisory Member IMPLEMENTATION TRUST GROUP TO RECONVENE Member Oviatt stated the agenda has a meeting time of 10:00 a.m. however; it has been dually noticed and revised to a 1:30 p.m. meeting. ROLL CALL: Present: Lorelei Oviatt, Jim Eggert, Thomas Leeman, James Buchanan, Annee Ferranti STAFF: Steve Sanders, Martin Ortiz, Pamela Elisheva, Cecelia Griego, Kate Shea, Dana Cornelius, Mitch Van Wyk * CONSENT AGENDA /OPPORTUNITY FOR PUBLIC COMMENT: 1. *APPROVE minutes for the MBHCP Implementation Trust Group meeting of May 23, 2013. 2. *Transmittal of FY 12 -13 Third Quarterly Report to the MBHCP Implementation Trust Group - RECEIVE AND FILE. 3. *Update on status of the probate completed on the Yard property - RECEIVE AND FILE. 4. *APPROVE payment to Mitch Van Wyk of $440 for the purchase of a one -year subscription to KernData.com property data base. 5. *APPROVE a request by the Panama -Buena Vista School District to use the Metropolitan Bakersfield Habitat Conservation Plan and related Incidental Take Permits (ESA #PRT 786634, CESA Section 2081). 6. *Purchase of Habitat Mitigation Land: For each property listed below, staff recommendation is as follows, with the specific purchase price recommendation listed with the property below: a) *APN 099 - 250-03 (7.46 acres) - being a portion of N Yz of NW '/4 of Section 4, T29S, R22E, MDM, County of Kern; located 5.5 miles northwest of the intersection of State Highway 58 and Lokern Road. The property is owned by the Max M. Friaell Trust and the proposed purchase price is $8,952 to be acquired by the State of California. APPROVE ACQUISITION AT PURCHASE PRICE OF $1,200 PER ACRE. b) *APN 047 - 050 -15 (90.92 acres) - being a portion of the western half of Section 5, T25S, R24E, MDM, County of Kern; located south of County Line Road, '/2 mile west of Scofield Avenue. The property is owned by the Carolyn Norton et al and the proposed purchase price is $136,380 to be acquired by the State of California. APPROVE ACQUISITION AT PURCHASE PRICE OF $136.380 PER ACRE. Staff requested a correction to Consent Agenda item 6.b to approve acquisition at purchase price of $1,500 per acre instead of $136,380 per acre as stated on the agenda. In addition, Staff also indicated Consent Agenda item 1. was read into the record as 2011 when actually it is 2013. Member Oviatt requested a motion to approve Consent Agenda with the two corrections. Member Eggert moved, seconded by Member Oviatt to approve the Consent Agenda. Roll Call: Members Oviatt, Eggert Motion carried. Public Presentations Presentation by Jeevan Muhar Arvin - Edison Water Storage District. Mr. Muhar stated he has provided the Trust Group a letter indicating they are requesting to include their Intake Canal area footprint into the MBHCP. He further stated he is not asking for any decision today and wanted to let the Trust Group know he will be working with Staff in providing additional information at a later date. Member Oviatt thanked Mr. Muhar and stated that his letter will be placed in file. Member Oviatt asked if anyone had questions. There were no questions. Implementation Trust Group Member Announcements or Reports None ADJOURN Member Eggert moved to adjourn this meeting to 10:00 a.m., November 21, 2013.
