BACKGROUND: On March 10, 2011, the Bakersfield Redevelopment Agency (the "Former RDA ") transferred a specified real property, located in the City of Bakersfield identified as APN 014- 270 -17 (the "Property "), to the City of Bakersfield (the "City "). The intent of the transfer was to allow the City to complete the redevelopment of the Property and increase the supply of affordable housing in the City. To that effect, the City, acting in its capacity as the Housing Successor to the former RDA, negotiated and executed a disposition and development agreement between the City and the Housing Authority of the County of Kern (the "Housing Authority ") under which, the Housing Authority will be required to develop 50 units of affordable housing on the Property. Under the DDA, the City has also committed to fund $3.6 million in Neighborhood Stabilization Program funds and HOME Program funds to make the project financially feasible, and the Housing Authority is providing $450,000 of its own funds to the project. Under AB 1x 26 and AB 1484 (collectively, the "Redevelopment Dissolution Statutes "), upon the dissolution of the Former RDA on February 1, 2012, all rights, powers, duties, obligations, and "housing assets" (as defined in Section 34176(e)) of the Former RDA transferred to the City (as the entity that retained the housing assets and function previously performed by the Former RDA under Health and Safety Code Section 34176(a) (1)). Health and Safety Code Section 34176(e) (1) defines "housing assets" to include any real property, whether improved or not, that was acquired for low- and moderate - income housing purposes, regardless of the source used to pay for the acquisition. The Former Agency acquired the Property for affordable housing purposes, evidenced by: (1) the Former Agency's use of eminent domain power to acquire the property in 2003 and 2004 to construct a mixed -use senior housing and commercial center project that would expand the available senior housing facilities in the plan area by 50 units; and (2) the Former RDA's previous disposition of the Property in 2006 to the Baker Street Village LLC under a disposition and development agreement for the Baker Street Village mixed -use affordable housing development. Because the Property was transferred to the City prior to the February 1, 2012, staff has recommended that the Oversight Board approve and ratify the transfer of the Property to the City as authorized under Health and Safety Code Sections 34176, 34177(g), and 34181(c), as a means of formalizing the validity of the transfer of the Property, a Housing Asset under Health and Safety Code Section 34176(e) (1), to the City as Housing Successor under the Redevelopment Dissolution Statutes. The project should proceed after this action. As with other Oversight Board actions, this action will be subject to the State Department of Finance's review and approval. JHR /vl Attachments: 1.
