HomeMy WebLinkAboutROI NO 1770RESOLUTION OF INTENTION NO. 1770 A RESOLUTION DECLARING INTENTION TO ESTABLISH THE WEST BELTWAY PLANNED MAJOR THOROUGHFARE AREA AND PRELIMINARILY APPROVING THE BOUNDARIES OF THE AREA AND THE COST AND FEE SCHEDULE. WHEREAS, Chapter 16.32.060.E of Title 16 of the Bakersfield Municipal Code and Section 66484 of the California Government Code, provides for a procedure by which the City Council may assess and collect fees for the purpose of defraying the cost of constructing bridge crossings or major thoroughfares identified in the transportation circulation element of the Metropolitan Bakersfield General Plan, and; WHEREAS, the West Beltway is designated as future freeway through western Metropolitan Bakersfield, and; WHEREAS, General Plan Amendment 03 -1544, to amend the Land Use, Kern River Plan Element and Circulation Element of the Bakersfield General Plan for the West Ming Project was adopted per Resolution 162 -07 of the City Council of the City of Bakersfield, and; WHEREAS, the developer of the West Ming Project, as a condition of approval for General Plan Amendment 03 -1544, is required to install or fund two lanes of the West Beltway to arterial standards from Ming Avenue to the Asphalto Railroad at no more than 80% build out of the project or within 1 year of completion of the Final Design of the West Beltway by the City of Bakersfield, whichever comes first, and; WHEREAS the City of Bakersfield desires to aid the developer in the formation of the West Beltway Planned Major Thoroughfare Area to fund the required two lanes, and; WHEREAS, the City has notified all affected property owners and is proposing the formation of the West Beltway Planned Major Thoroughfare Area to reimburse the cost of the improvements upon subdivision or development of property within the Area. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: The foregoing recitals are true and correct and are incorporated herein. 2. The Council hereby preliminarily approves the estimate, attached hereto as Exhibit A, the fee schedule attached hereto as Exhibit B, the limits of improvements as shown on Exhibit C and the boundary of the area benefited by the construction as described on the map attached hereto as Exhibit D, for the West Beltway Planned Major ] �gNKF9 ti m r- J G ORIO,INAi Thoroughfare Area. Subdivision or development of property within such Area will require payment of fees per the attached schedule. 3.
