AMENDMENT NO. 1 TO RESOLUTION NO. 128 -12
SPECIFYING WHEN CONSTRUCTION OF QUALIFYING CUL-
DE -SACS ON BEECH, MYRTLE, SPRUCE, PINE, CEDAR, A, B
AND C STREETS SOUTH OF 24TH STREET MAY OCCUR.
WHEREAS, on November 14, 2012, the City Council adopted Resolution No.
128 -12, which allows for the closure of, and construction of cul -de -sacs on
Beech, Myrtle, Spruce, Pine, Cedar, A, B, and C Streets south of 24th Street; and
WHEREAS, Resolution No. 128 -12 allows cul -de -sacs to be constructed on
the portion of those streets adjacent to 24th Street if (1) all property owners
between 24th and 22nd Streets on the affected street agree to the closure by
signing a petition; and (2) the owners of the property adjacent to 24th Street
agree to donate sufficient property to construct the cul -de -sac to City
standards; and
WHEREAS, Resolution No. 128 -12 does not provide for the specific timing of
construction of cul -de -sacs on streets that meet these requirements; and
WHEREAS, City Council has determined that Resolution No. 128 -12 should
be amended to clarify when construction of qualifying cul -de -sacs should take
place.
NOW, THEREFORE, BE IT RESOLVED by the Bakersfield City Council as
follows:
1. The above recitals are true and correct and incorporated herein by
reference.
2. The language of Resolution No. 128 -12 is hereby repealed and
replaced by the following:
1. The Planning Commission's findings as contained in its
Resolution 32 -12 are hereby adopted.
2. The Negative Declaration prepared for the 24th Street Cul -de-
sac Project is hereby adopted.
3. The construction of cul -de -sacs along the south side of 24th AK F
Street at the intersections with Beech, Myrtle, Spruce, Pine,c; 9(PI

Cedar, A, B, and C Streets is hereby approved, as shown in
attached Exhibit A, subject to the following conditions:
a. All property owners between 24th and 22nd Streets
along the affected street must agree to the closure by
their signing of a petition signifying such; and
b. The owners of the properties adjacent to 24th Street on
each street requesting a cul -de -sac must agree to
donate sufficient property to construct the cul -de -sac
to City standards; and
4. Cul -de -sacs on Beech, Myrtle, Spruce, Pine, Cedar, A, B, and
C Streets south of 24th Street meeting the requirements set
forth above may be constructed at a time agreed upon by
the City's Public Works Director and the property owners
between 24th and 22nd Streets on the street requesting the
cul -de -sac.
