RESOLUTION OF THE CITY OF BAKERSFIELD ADOPTING THE WEST
BELTWAY PLANNED MAJOR THOROUGHFARE AREA AND
MAKING FINDINGS RELATIVE THERETO.
WHEREAS, by Resolution of Intention No. 1770, adopted January 8, 2014, a
public hearing was called for January 22, 2014, at the hour of 5:15 pm in the Council
Chambers in the City Hall, 1501 Truxtun Avenue, Bakersfield, California, regarding the
establishment of the West Beltway Planned Major Thoroughfare Area; and
WHEREAS, notice of such hearing has been given to all affected property
owners as such are shown on the latest equalized assessment roll; and,
WHEREAS, such hearing has been duly and regularly held, and all persons
interested have been given an opportunity to appear and be heard.
as follows:
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
1. The foregoing recitals are true and correct and incorporated herein by
reference.
2. The West Beltway Planned Major Thoroughfare Area has been
identified in the circulation element of the 2010 General Plan.
3. The West Beltway Planned Major Thoroughfare Area is in addition to
existing major thoroughfares serving the area.
4. No majority protest as to the formation of the West Beltway Planned
Major Thoroughfare Area exists.
5. The Council hereby finds that, as to the West Beltway Planned Major
Thoroughfare Area, as described in the plans and maps attached
hereto and incorporated herein by reference, subdivision and
development of property within each such area will require
construction of facilities, described in each such area either on the
basis of benefits conferred on property for subdivision or on the need
for such facilities created by the proposed subdivision and
development of other property within such area, and that the fees
provided within the schedule attached, are fairly apportioned.
6. The West Beltway Planned Major Thoroughfare Area Plan is hereby
adopted.
