RESOLUTION OF THE COUNCIL ORDERING THE VACATION
OF PORTIONS OF A PUBLIC UTILITY EASEMENT AS
CREATED WITH TRACT MAP 6444, PHASE 2, WITHIN LOT 132. (WARD 3)
WHEREAS, on WEDNESDAY, FEBRUARY 12, 2014, the Council of the City of
Bakersfield, pursuant to the provisions of the "Public Streets, Highways and Service
Easements Vacation Law," Government Code Sections 8300 et seq. of the Streets and
Highways Code of the State of California, passed and adopted Resolution of Intention
No. 1771 declaring its intention to order the vacation of a public utility easement as
created with Tract Map 6444, Phase 2, within Lot 132; and
WHEREAS, the Council did fix a time and place for hearing all persons interested
in or objecting to said proposed vacation, which hearing was held on January 22, 2014,
after notices of said hearing were duly published and posted as required by law; and
WHEREAS, for the above - described project, it was determined that the proposed
vacation is exempt from CEQA, pursuant to Section 15061 (b) (3) of CEQA Guidelines
(General Rule) in that there is no possibility that the proposed action could have a
significant effect on the environment; and
WHEREAS, Planning Department approved the vacation on December 20, 2013,
per local ordinance and found it to be consistent with the Metropolitan Bakersfield
General Plan.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as
follows:
1. The above recitals are true and correct and are incorporated herein.
2. This Resolution is adopted pursuant to Section 8300, et seq. of the Streets and
Highways Code of the State of California.
3. The Council orders the vacation of a public utility easements as created with
Tract Map 6444, Phase 2, within Lot 132, (more specifically described and
illustrated in Exhibit A and Exhibit B, both of which are attached hereto and
incorporated herein), all in the City of Bakersfield, County of Kern, State of
California.
4. The City Clerk shall certify to the passage of this resolution and shall cause a
certified copy hereof, attested by the Clerk under the seal of the City, to be
recorded in the Office of the County Recorder of the County of Kern, California.

LEGAL DESCRIPTION
OF PUBLIC UTILITY EASEMENT VACATION
Being that portion of Lot 132 of Tract No. 6444 Phase 2 in the City of Bakersfield, County of Kern,
State of California, as shown on a map filed in Book 57, Pages 12 through 16, inclusive, of Maps in
the office of the County Recorder of said County, described as follows:
Beginning at the southwesterly terminus of that certain curve shown as "0= 101 °40'04" R= 20.00'
L= 35.49 "' in the southeasterly boundary of said Lot; thence along said southwesterly and westerly
line of said Lot the following two (2) courses: North 77 °44'05" West 78.32 feet and North 00 °35'51"
West 10.21 feet to a line which is parallel with and distant 10.00 from the southwesterly boundary of
said Lot; thence along said parallel line South 77 °44'05" East 80.38 feet to a point on a radial line
from said southwesterly terminus; thence along said radial line South 12 °15'55" West 10.00 feet to
the Point of Beginning.
Containing an area of 793 square feet, more or less.
As shown on Exhibit "B" attached hereto and by this reference made a part hereof.
