A RESOLUTION DETERMINING THAT A COMPLETE SET OF CREEKVIEW
VILLAS ENGINEERING CONSTRUCTION DOCUMENTS CANNOT BE
REASONABLY OBTAINED THROUGH THE USUAL BIDDING PROCEDURES
AND AUTHORIZE THE FINANCE DIRECTOR TO DISPENSE WITH BIDDING
THEREFORE AND PURCHASE ALL UPDATED CONSTRUCTION
DOCUMENTS FROM KNITTER AND ASSOCIATES PLANNING AND
ARCHITECTURE (KAAP) FOR CONSTRUCTION OF CREEKVIEW VILLAS
PHASE II.
WHEREAS, the CITY of Bakersfield desires a complete set of current
engineering construction documents to be resubmitted for plan check and
construction of Creekview Villas Phase ll; and
WHEREAS, the California Building Code has been updated two times since
the original Creekview Villas engineering construction documents were
prepared; and
WHEREAS, Creekview Villas, LLC separately bid out the plumbing,
mechanical, and electrical drawings which further complicates the process to
update the existing construction documents; and
WHEREAS, the City of Bakersfield desires a complete set of updated
engineering construction documents provided by a single entity to simplify the
bidding process for construction of Creekview Villas Phase II; and
WHEREAS, the City of Bakersfield staff is currently preparing a Request For
Qualifications (RFQ) Proposal to prequalify general contractors to begin
Construction of Creekview Villas Phase Il; and
WHEREAS, the City of Bakersfield staff contacted Knitter and Associates
Architecture and Planning ( "KAAP" hereinafter) firm that prepared a part of the
original engineering construction documents to update and integrate the
existing plans into one complete set of construction documents; and
WHEREAS, KAAP continues to have copyright and intellectual property
rights in the original construction documents; and
WHEREAS, KAAP is intimately familiar with the Creekview Villas plans and
will ensure the updated plans comply with the California Building Code and
completely integrates the existing theme, color scheme, and compatibility of
future phases with the existing housing product; and,

WHEREAS, Bakersfield Municipal Code ( "BMC ") Section 3.20.060D.2 allows
the City to dispense with bidding procedures when it is determined that work,
supplies, equipment, or materials to be purchased can only be reasonably
obtained from one vendor because of restricted availability of such work,
supplies, equipment, or materials, or it is necessary to successfully integrate such
work, supplies, equipment, or materials into an existing city project or system.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
BAKERSFIELD AS FOLLOWS:
Section 1. The above recitals are true and correct and incorporated
herein by reference.
Section 2. City Council hereby finds that the purchase of the necessary
architectural and planning services for the Creekview Villas Project can only be
obtained from KAAP for the reasons stated above.
Section 3. The requirements for dispensing of bidding procedures under
BMC Section 3.20.060D.2 are met.
Section 4. The Finance Director is authorized to dispense with bidding in
accordance with Section 3.20.060 of the Bakersfield Municipal Code.
