HomeMy WebLinkAboutROI NO 1779RESOLUTION OF INTENTION NO. 1779 A RESOLUTION DECLARING INTENTION TO ESTABLISH A REVISED DRAINAGE PLAN FOR THE PIONEER PLANNED DRAINAGE AREA AND PRELIMINARILY APPROVING THE REVISED COST, FEE SCHEDULE, AND THE BOUNDARIES OF THE AREA (WARD 3) WHEREAS, Chapter 16.32.060.D of Title 16 of the Bakersfield Municipal Code and Section 66483 of the California Government Code, provide for a procedure by which the City Council may assess and collect fees for the purpose of defraying the cost of constructing drainage facilities for local and neighborhood drainage areas, and; WHEREAS, the City of Bakersfield desires to provide storm and surface water drainage facilities for a rapidly developing area located in the northeast portion of Bakersfield in order to prevent drainage damage to land development within the area and to properly control storm and surface water run -off from said area, and; WHEREAS, the original Pioneer Planned Drainage Area was adopted by the City of Bakersfield on July 19, 1981 and is currently part of Ordinance Section 16.32.060 of the Bakersfield Municipal Code relating to Drainage Facilities, and; WHEREAS, recent development in the area has brought a need to update the Pioneer Planned Drainage study to include a new hydrology study with modern computer modeling to provide a better estimate of runoff from rainfall and has resulted in some pipe size and basin volume modifications, and; WHEREAS, City is revising the Pioneer Planned Drainage Area to pay for construction of those drainage facilities not yet built that serve the area identified in Exhibit A (attached hereto and incorporated by reference) and to reimburse the cost of the improvements already constructed upon subdivision or development of property within the area, and; WHEREAS, the planned drainage area fees have not been updated since their initial adoption in 1981 and no longer reflect current costs, and; WHEREAS, the planned drainage fees set forth in Exhibit B attached hereto and incorporated by reference, do not exceed the reasonable estimated cost based to provide drainage services; S; \PROJECTS \PSA,PDA \Pionner PDA Package \Revised Pioneer PDA_Res of Int.docx Page 1 of 3 �gAKFq F- M11 ORIGNA; NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The foregoing recitals are true and correct and are incorporated herein. 2. The Council hereby preliminarily approves the revised boundary of the Pioneer Planned Drainage Area as described on the map attached hereto as Exhibit A, the fee schedule attached hereto as Exhibit B, and the cost estimate attached hereto as Exhibit C. 3. Subdivision or development of property within such area will require payment of fees per the attached schedule. 4, The City Council hereby fixes Wednesday, May 7, 2014, at 5:15 PM, or as soon as thereafter as may be heard, at the Council Chambers of the City Council, 1501 Truxtun Avenue, Bakersfield, California, as the time and place for hearing protests on this matter.
