AN ORDINANCE AMENDING THE TEXT OF THE
BAKERSFIELD MUNICIPAL CODE, SECTION 17.30.030 (M-2
ZONE - USES PERMITTED BY CONDITIONAL USE PERMIT),
REMOVING LANGUAGE THAT REFERENCES DAIRIES,
STOCKYARDS AND OTHER ANIMAL CONFINEMENT USES
WHEREAS, the City of Bakersfield initiated a proposal to amend Title17 of the
Bakersfield Municipal Code, Section 17.30.030 (M-2 zone - Uses Permitted by Conditional
Use Permit), removing language that references dairies, stockyards and other animal
confinement uses; and
WHEREAS, the Planning Commission through its Secretary set Thursday,
December 6, 2001 at the hour of 5:30 p.m. in the Council Chambers of City Hail, 1501 Truxtun
Avenue, Bakersfield, California, as the time and place for a public hearing before said
Commission on said ordinance, and notice of the public hearing was given in the manner
prescribed in the Municipal Code and the California Government Code; and
WHEREAS, the Planning Commission adopted Resolution No. 145-01
recommending approval of the proposed ordinance amendment and forwarded its
recommendation to the City Council; and
WHEREAS, the City Council through its City Clerk set Wednesday, January 9,
2002 at the hour of 7:00 p.m. in the Council Chambers of City Hall, 1501 Truxtun Avenue,
Bakersfield, California, as the time and place to consider said ordinance; and
WHEREAS, the ordinance was found to be exempt from the provisions of CEQA
and the law and regulations as set forth in CEQA and the City of Bakersfield's CEQA
Implementation Procedures have been duly followed by city staff and this Council; and
WHEREAS, the City Council, at said public meeting, considered the ordinance,
all relevant facts, and public testimony, and the Council adopted the findings made by the
Planning Commission as contained in said Commission's resolution.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield
as follows:
SECTION 1.
Section 17.30.030 is hereby amended to read as follows:
Uses Permitted Only by Conditional Use Permit.
While any use may be permitted by conditional use permit pursuant to
Subsection B of Section 17.64.020, the following uses are not permitted in the
M-2 zone except by conditional use permit issued in accordance with the
procedures provided in Chapter 17.64 of this title:

B. Ammunition manufacture.
C. Cement, lime, gypsum or plaster of Paris manufacture.
D. Chemical manufacture.
E. Curing, tanning and storage of raw hide or skins.
F. Distillation of bones.
G. Drop forge industries manufacturing forgings with power hammers.
H. Dumps and refuse disposal areas.
I, Explosives, manufacture or storage.
J. Fat rendering.
K. Feed and fuel yards.
L. Fertilizer manufacture.
M. Food and/or shelter service agencies as defined in Section 17.04.285.
N. Garbage, offal or dead animal reduction or dumping.
O. Gas manufacture.
P. Gelatin or size manufacture.
Q. Glucose or dextrine manufacture.
R. Glue manufacture.
S. Nonmineral oil extraction plants.
T. Sewer farms or sewage disposal plants.
U. Smelting of tin, copper, zinc or iron ores.
V Slaughterhouse
W. Scrap metal yards, junkyards.
X. Wineries.
SECTION 2.
This ordinance shall be posted in accordance with the Bakersfield Municipal
Code and shall become effective thirty (30) days from and after the date of its passage.
