I Q, 0 — 14 A RESOLUTION DISPENSING WITH BIDDING PROCEDURES DUE TO URGENT NECESSITY TO CONSTRUCT A NEW WAREHOUSE BUILDING FOR STORING POLICE EVIDENCE, NOT TO EXCEED $750,000 RECITALS WHEREAS, on July 13, 2013, the City of Bakersfield (City) entered into Agreement No. 13 -104 with the Kern County High School District (District) to lease a warehouse building located at 1417 H Street, adjacent to Bakersfield High School, for the purpose of storing police evidence; and WHEREAS, on December 18, 2013, Kern High School District issued a notice that the City shall vacate the warehouse building by December 31, 2014 so that the District can accomplish site improvements to Bakersfield High School; and WHEREAS, to meet the needs of the City's Police Department, the future evidence warehouse should be within a one -mile radius of the Kern County Court buildings for efficiency in retrieving and returning evidence used during court proceedings, be at least 12,320 square feet in size (equal in size to current evidence room warehouse); allow for future expansion, and require minimal tenant improvements for leased property; and WHEREAS, the City has evaluated several buildings for either lease or purchase within the immediate area of the Kern County Court buildings for potential relocation of the Police Department's property evidence warehouse; WHEREAS, the potential buildings that were evaluated by staff for either lease or purchase do not offer optimal conditions required for a property evidence warehouse necessitated by a metropolitan police force of Bakersfield's size; and WHEREAS, the City owns property on Truxtun Avenue adjacent to SR 99 that can accommodate a properly sized property evidence warehouse, is within a one mile radius of Kern County Court buildings, and allows for future expansion; and WHEREAS, there is currently no building on this site; therefore, a property evidence warehouse must first be constructed before the lease with the District terminates; and - Page 1 of 3 Pages - 6AK,�q O cP� G: \GROUPDAT \ADMINRPT \2014 \06 -25 \Evidence Room - Resolution.doc i m 0 V WHEREAS, given the necessity of construction of the new evidence warehouse before the end of Calendar Year 2014, the City must dispense with bidding requirements for the construction of the Police Department evidence room on the proposed new site. NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Bakersfield as follows: The above recitals are true and correct and are incorporated herein by reference. 2. Based on the facts included in the above recitals, the police evidence storage warehouse is of urgent necessity for the preservation of life, health or property, thereby allowing the dispensing of bidding requirements as set forth in Section 3.20.060 of the Bakersfield Municipal Code. 3. The Finance Director is authorized to dispense with bidding in accordance with Section 3.20.060 of the Bakersfield Municipal Code. 4.
