a RESOLUTION ADOPTING a NEGATIVE
DECLARATION WITH MITIGATION MEASURES
FOR THE WHITE LANE/HIGHWAY 99 INTERCHANGE
RECONSTRUCTION PROJECT
WHEREAS, in cooperation with the California Department of Transportation, the
City of Bakersfield has taken the lead to reconstruct the interchange at White Lane and Highway
99; and
WHEREAS, the purpose of the reconstruction project is to improve traffic flow,
traffic safety, and to mitigate traffic related noise impacts at the intersection of White Lane and
Highway 99; and,
WHEREAS, the project involves the widening of White Lane at Highway 99,
improvements to the interchange, and construction of an auxiliary lane at the southbound exit
ramp; and
WHEREAS, improvements will occur on White Lane, between Wible Road and El
Potrero Lane, and along Highway 99 just south and north of the existing White Lane on- and off-
ramps; and
WHEREAS, the City of Bakersfield is considering two alternatives to address specific
traffic related deficiencies at the intersection of White Lane and Highway 99; and
WHEREAS, the two alternatives are referred to as the Widen Partial Cloverleaf
Alternative and Modified Point Diamond Alternative and both have been analyzed equally
throughout the Initial Study prepared for the project; and
WHEREAS, the two alternatives address the widening of White Lane from four lanes to
six lanes, realignment of the existing ramps, signalization of the northbound exit ramp terminal
intersection, widening of the southbound exit ramp, and addition of a southbound auxiliary lane
prior to the southbound exit ramp; and
WHEREAS, for the above-described proposal, an Initial Study was conducted
and it was determined that the proposed project would not have a significant effect on the
environment if certain mitigation measures were adopted to address potential impacts regarding
Aesthetics, Air Quality, Biological Resources, Geology and Soils, Hazards and Hazardous
Materials, Hydrology and Water Quality, Noise, and Transportation/Traffic, and, therefore, a
Negative Declaration with mitigation measures was prepared and posted on November 19,
2001, in accordance with CEQA; and
WHEREAS, during the review period from November 19, 2001, to December 18, 2001,
the City of Bakersfield received one comment from the Califomia~Regional Water Quality Control
Board and the City of Bakersfield has adequately addressed the comment; and
WHEREAS, the law and regulations relating to the preparation and adoption of
Negative Declarations as set forth in CEQA and the City of Bakersfield's CEQA Implementation
Procedures, have been duly followed by city staff and this Council; and
WHEREAS, pursuant to the National Environmental Policy Act (NEPA), the
Federal Highway Administration, in cooperation with the California Department of
Transportation, is processing a Categorical Exclusion for the project; and
WHEREAS, the Council of the City of Bakersfield, in accordance with the
provisions of Section 21092 of the Public Resources Code, conducted and held a public hearing
on WEDNESDAY, January 23, 2002, on the above Negative Declaration for the reconstruction
project at the intersection of White Lane and Highway 99, notice of time and place of the hearing
having been given more than thirty (30) calendar days before the hearing by publication in the
Bakersfield Californian, a local newspaper of general circulation; and
WHEREAS, the Council has considered and hereby makes the following findings:
1. All required public notices have been provided.
2. The provisions of the California Environmental Quality Act have been met.
The proposed project would not have a significant effect on the environment if
certain mitigation measures are adopted to address potential impacts regarding
Aesthetics, Air Quality, Biological Resources, Geology and Soils, Hazards and
Hazardous Materials, Hydrology and Water Quality, Noise, and Transportation/
Traffic.
The proposed project is consistent with the Metropolitan Bakersfield 2010
General Plan.
Based on the absence of evidence in the record as required by Section 21082.2
of the State of California Public Resources Code (CEQA) for the purpose of
documenting significant effects, it is the conclusion of the Lead Agency that this
project will result in impacts that fall below the threshold of significance with
regard to wildlife resources and, therefore, must be granted a "de minimis"
exemption in accordance with Section 711.4 of the State of California Department
of Fish and Game Code. Additionally, the assumption of adverse effect is
rebutted by the above-reference absence of evidence in the record and the Lead
Agency's decision to prepare a Negative Declaration for this project.
NOW, THEREFORE, IT iS HEREBY FOUND AND RESOLVED AS FOLLOWS:
1. The above recitals, incorporated herein, are true and correct.
The Negative Declaration with mitigation measures is hereby adopted for the
White Lane/Highway 99 Interchange Reconstruction Project.
The Mitigation Monitoring and Reporting Checklist proposed in Exhibit A is
hereby adopted.
The Planning Division of the Development Services Department is hereby
directed to file a Notice of Determination with the County Clerk of Kern County,
pursuant to the provisions of Section 21152 of the Public Resources Code and
Section 15094 of the CEQA Guidelines adopted pursuant thereto and a
Certificate of Fee Exemption pursuant to Section 711.4 (c)(2)(B) of the State of
California Department of Fish and Game Code.
I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by
the Council of the City of Bakersfield at a regular meeting thereof held on January 23, 2002, by

Hydrology And Water Quality

System (NPDES) permit with the California State Water Resources Deployment During

Plan (SWPPP), and Monitoring Plan shall be submitted to the City
Engineer a minimum of thirty (30) days prior to commencing grading
operations. The SWPPP shall emphasize structural and non-
structural Best Management Practices (BMPs) in compliance with
NPDES Program requirements. Specific measures shall include:
· The project shall provide appropriate energy dissipators in
stormwater conduits and storm drain outlets.
· Surplus or waste matedal from construction shall not be
p~aced in drainage ways or within the 100-year floodplain
· All loose piles of soit, silt, clay, sand, debris, or other
earthen materials shall be protected in a reasonable
manner to eliminate any discharge to waters of the State.
· During construction, temporary graver or sandbag dikes
shall be used as necessary to prevent discharge of earthen
materials from the site during periods of precipitation or
runoff.
· Stabilizing agents such as straw, wood chips and/or
hydroseeding shall be used during the interim peded after
grading in order to strengthen exposed soil while ground
cover takes hold.

Transportation/Traffic

from businesses. Proper detours and waming signs shall be
established to ensure public safety. The Traffic Management Plan
shall be devised so that construction shall not intefi~ere with any
emergency response or evacuation plans. Construction activities
shall proceed in a timely manner to reduce impacts.
