HomeMy WebLinkAboutROI NO 1119RESOLUTION OF INTENTION NO.1119 A RESOLUTION OF THE COUNCIL DECLARING ITS INTENTION TO ORDER THE VACATION OF KING STREET BETWEEN EAST 19TH STREET AND EAST TRUXTUN AVENUE IN THE CITY OF BAKERSFIELD. WHEREAS, Monte and Tonia Valpredo submitted a request for vacation of King Street between East 19th Street and East Truxtun Avenue; and WHEREAS, at its meeting on July 18, 1991, the vacation was duly heard and considered by the Planning Commission and was found to be consistent with the Metropolitan Bakersfield 2010 General Plan. NOW, T~tEREFORE BE 1T RESOLVED by the Council of the City of Bakersfield as follows: 1. The above recitals are true and correct and are incorporated herein. 2. This resolution is adopted pursuant to Division 9, Part 3, Chapter 3 of the Street and Highways Code of the State of California. 3. The Council intends to order the vacation of King Street between East 19th Street and East Truxtun Avenue, in the City of Bakersfield, County of Kern, State of California as shown on Exhibit "A" attached hereto and more particularly described as follows: That portion of right of way for King Street being 80 feet in width (per "Map of Kern" filed April 10, 1893 in the office of the Kern County Recorder) bounded westerly by the east line of Block 125, bounded easterly by the west line of Block 126, bounded northerly by the south right of way line of East 19th Street and bounded southerly by the north right of way line of East Truxtun Avenue relocated. 4. The south 5 feet of the west 40 feet of the above described vacated area shall be reserved as nonexclusive easement and right of way for existing City of Bakersfield storm drain facilities. 5. 7:00 P.M. on Wednesday, July 13, 1994, in the Council Chambers, City Hall, 1501 Truxtun Avenue, Bakersfield, California, is hereby fixed as the time and place when all persons interested in or objecting to the proposed vacation may appear before the City Council and be heard. 6. The City Clerk shall cause notice of the date, hour and place of said hearing on this resolution to be published for two successive weeks prior thereto in the Bakersfield Californian and the Superintendent of Streets of the City of Bakersfield, California, shall cause "Notice of Vacation" to be posted as required by Section 8323 of the Streets and Highways Code of the State of California. 7. The City Clerk shall certify to the passage of this resolution and shall cause the same to be posted on the bulletin board at the City Hall, 1501 Truxtun Avenue, in the City of Bakersfield, California, within fifteen 05) days after its passage.
