HomeMy WebLinkAboutROI NO 1125RESOLUTION OF INTENTION NO. 1125 A RESOLUTION OF THE COUNCIL DECLARING ITS INTENTION TO ORDER THE VACATION OF 26TH STREET BETWEEN "H" STREET AND EYE STREET AND THE ADJACENT ALLEY IN BLOCK 115 IN THE CITY OF BAKERSFIELD. WHEREAS, SAN JOAQUIN COMMUNITY HOSPITAL submitted a request for vacation of 26TH Street between "H" Street and Eye Street and the adjacent alley in Block 115 in the City of Bakersfield; and WHEREAS, at its meeting on September 1, 1994, the vacation was duly heard and considered by the Planning Commission and was found to be consistent with the Metropolitan Bakersfield 2010 General Plan. NOW, THEREFORE BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The above recitals are true and correct and are incorporated herein. 2. This resolution is adopted pursuant to Division 9, Part 3, Chapter 3 of the Street and Highways Code of the State of California. 3. The Council intends to order the vacation of 26th Street between "H" Street and Eye Street and the adjacent alley in Block 115 in the City of Bakersfield, County of Kern, State of California and more particularly described as follows: Parcel 1: That portion of public road right of way (82.5 feet in width) for 26th Street, bounded westerly by the northerly prolongation of west line of Block 115 and bounded easterly by a line parallel with the center line of Eye Street and 50 feet west of said center line as measured at a right angle therefrom; as per "Map of the City of Bakersfield", Kern County, California, filed November 25, 1898 in the office of the Kern County Recorder. Parcel 2: All of the 20 foot wide alley in said Block 115 being bounded by the south right of way line of 26th Street and the north right of way line of 25th Street. 4. A nonexclusive easement shall be reserved for public utilities purposes in, under, over and upon the south 26 feet of above described Parcel 1 (26th Street) and the entire alley area in above described Parcel 2 and the northerly prolongation of said alley to meet the north right of way line of 26th Street. 5. An easement shall be reserved by the City of Bakersfield for public storm drain purposes in, under and upon the south 15 feet of the north 33 feet of above described Parcel 1 (26th Street). 6. All of or a portion of the reserved public storm drain easement (Item 5) within said vacated street shall automatically terminate and be abandoned as an easement when the applicant provides the following: Relocation of the existing public storm drain line to City of Bakersfield standards and acceptance; and Dedication of an adequate easement for any relocated city storm drain facilities extending through private property with alignment thereof approved by the City. 7. 7:00 P.M. on Wednesday, November 2, 1994, in the Council Chambers, City Hall, 1501 Truxtun Avenue, Bakersfield, California, is hereby fixed as the time and place when all persons interested in or objecting to the proposed vacation may appear before the City Council and be heard. 8. The City Clerk shall cause notice of the date, hour and place of said hearing on this resolution to be published for two successive weeks prior thereto in the Bakersfield Californian and the Superintendent of Streets of the City of Bakersfield, California, shall cause "Notice of Vacation" to be posted as required by Section 8323 of the Streets and Highways Code of the State of California. 9. The City Clerk shall certify to the passage of this resolution and shall cause the same to be posted on the bulletin board at the City Hall, 1501 Truxtun Avenue, in the City of Bakersfield, California, within fifteen (15) days after its passage.
