A RESOLUTION OF THE COUNCIL DECLARING ITS IN'I/zkNTION TO ORDER
THE ABANDONMEIqT OF A 50 FOOT PORTION OF THE DEDICATED WAIVER OF
VEHICULAR ACCESS RIGHTS ALONG WHITE LANE AT THE NORTHEAST CORNER OF
PARCEL "A" OF PARCEL MAP NO. 8383 IN THE CITY OF BAKERSFIED.
WHEREAS, M. D. ATKINSON CO~ INC. submitted a request for the abandonment of a 50 foot portion of the
dedicated waiver of vehicular access rights along White Lane at the Northeast corner of Parcel "A~ of Parcel Map No.
8383 in the City of Bakersfield; and
WHEREAS, at its meeting on October 31, 1994, the vacation was duly heard and considered by the Planning
Commission and was found to be consistent with the Metropolitan Bakersfield 2010 General Plan.
NOW, THEREFORE BE IT RESOLVED by the Council of the City of Bakersfield as follows:
1. The above recitals are true and correct and are incorporated herein.
2. This resolution is adopted pursuant to Division 9, Part 3, Chapter 3 of the Street and Highways Code of the
State of California.
3. The Council intends to order the abandonment of a 50 foot portion of the dedicated waiver ofvehicolar access
rights along White Lane at the northeast corner of Parcel "A" of Parcal Map No. 8383 in the City of Bakersfield, County
of Kern, State of California and more particularly described as follows:
Beginning at the northeast corner of Parcel "A" of Parcel Map No. 8383 fried for record in Book 34 of Parcel Maps at
Page 144 in the office of the Kern County Recorder, said corner also being on the south right of White Lane;
THENCE North 8912'44" West, along the north line of said parcel "A" (and road right of way line), a distance of 50.00
feet.
Waiver of vehicular access rights along the portion of White Lane was dedicated by road easements filed for record in
Book 5510, Page 1441, Official Records, in the office of the Kern County recorder.
4. As a condition of completion of said vacation, pursuam to Section 8324 of the Streets and Highways
Code of the State of California, the petitioner shall provide the following:
Applicant shall constrnet and dedicate fight of way for a right turn deceleration lane along
White Lane for access to 'the additional easterly driveway following Caltrans and City
Standards, with City approval of the plans.
Applicant shall relocate existing monument sign and regrade and/or replant existing landscape
berm to comply with required dear sight view and city sign ordinance. The Planning
Department notes that the revised sign ordinance allows a maximum of (2) monument signs
per street frontage in an M-1 Zone.
5. 7:00 P.M. on Wednesday, January 25, 1994, in the Council Chambers, City Hall, 1501 Truxtun Avenue,
Bakersfield, California, is hereby fixed as the time and place when all persons interested in or objecting to the proposed
vacation may appear before the City Council and be heard.
6. The City Clerk shall cause notice of the date, hour and place of said hearing on this resolution to be punished
for two successive weeks prior thereto in the Ba le --an and the Superintendent of Streets of the City of
Bakersfield, California, shall cause "Notice of Vacation" to be posted as required by Section 8323 of the Streets and
Highways Code of the State of California.
7. The City Clerk shall certify to the pasaage of this resolution and shall cause the same tO be po~ted on the
bulletin board at the City Hall, 1501 Truxtun Avenue. in the City of Bakersfield, California. within fifteen (15) days after
its passage.
