HomeMy WebLinkAboutROI NO 1132RESOLUTION OF INTENTION NO. 11:52 A RESOLUTION OF THE COUNCIL DECLARING ITS IN'I]:~ITION TO ORDER THE VACATION OF THE UNIMPROVED PORTION OF GEORGIA DRIVE (ACCESS EASEM~N~ ALONG THE NORTHWEST SIDE OF PARCEL "Aw OF PARCEL MAP NO. 3861 IN THE CITY OF BAKERSFII~I.D. WHEREAS, Mr. & Mrs. Warren M. Barr submitted a request for vacation of the unimproved portion of Georgia Drive (access easement) along the Northwest side of Parcel ~A" of Parcel Map No. 3861 in the City of Bakersfield; and WHEREAS, at its meeting on Octol~r 31, 1994, the vacation was duly heard and considered by the Planning Commission and was found to be consistent with the Metropolitan Bakersfield 2010 General Plan. NOW, THEREFORE BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The above recitals are true and correct and are incorporated herein. 2. This resolution is adopted pursuant to Division 9, Part 3, Cl~apter 3 of the Street and Highways Code of the State of California. 3. The Council intends to order the vacation of the unimproved portion of Georgia Drive (access easement) along the northwest side of Parcel 'A~ of Parcel Map No. 3861 in the City of Bakersfield, in the City of Bakersfield, County of Kern, State of California, more particularly described as follows: A portion of the access easement filed for record in Book 4872, page 1996, Official Records, and shown as "Georgia Drive" on Parcel Map No. 3861 fded for record in Book 19 of Parcel Maps, Page 38 in the office of the Kern County Recorder, said portion being described as follows: That 30 foot wide portion of Georgia Drive adjacent to the northwest boundary line of Parcel "A" of said Parcel Map No. 3861, being bounded by the north line of said Parcel ~A' and the east line of the west 30 feet of said Parcel "A~. 4. A nonexclusive easement shall be reserved for public utilities purposes in, under, over and upon a 15 foot wide strip of land within said vacating area adjacent to all of that portion of the northwest line of said Parcel WA" described 5. 7.~0 P.M. on Wednesday, January 25, 1994, in the Council Chambers, City Hall, 1501 Tmxtun Avenue, Bakersfield, California, is hereby fixed as the time and place when all persons interested in or objecting to the proposed vacation may appear before the City Council and be heard. 6. The City Clerk shall cause notice of the date, hour and place of said hearing on this resolution to be published for two successive weeks prior thereto in the Bakersfield Callfomian and the Superintendent of Streets of the City of Bakersfield, California, shall cause '~lotice of Vacation" to be posted as required by Section 8323 of the Streets and Highways Code of the State of California. 7. Thc City Clerk shall certify to thc passage of this resolution and shall cause thc same to be posted on the bulletin board at thc City Hall, 1501 Truxtun Avenue, in the City of Bakersfield, California, within fifteen (15) days after its passage.
