A RESOLUTION OF THE COUNCIL DECLARING ITS INTENTION TO ORDER
THE VACATION OF THE UNUSED NORTH 10 FEET OF THE 30 FOOT WIDE,
EAST/WEST ALLEY IN BLOCK 461 (WEST OF ELM STREET BETWEEN 21ST
AND 22ND STREETS) IN THE CITY OF BAKERSFIELD.
WHEREAS, William R. Thompson II submitted a request for vacation of the unused
north 10 feet of the 30 foot wide, east/west alley in Block 461 (west of Elm Street between
21st an 22nd Streets) in the City of Bakersfield; and
WHEREAS, at its meeting on January 5, 1995, the vacation was duly heard and
considered by the Planning Commission and was found to be consistent with the
Metropolitan Bakersfield 2010 General Plan.
NOW, THEREFORE BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1. The above recitals are true and correct and are incorporated herein.
2. This resolution is adopted pursuant to Division 9, Part 3, Chapter 3 of the Street
and Highways Code of the State of California.
3. The Council intends to order the vacation of the unused north 10 feet of the 30
foot wide, east/west alley in Block 461 (west of Elm Street between 21st an 22nd Streets)
in the City of Bakersfield, County of Kern, State of California and more particularly
described in Exhibit "A" attached hereto and made a part hereof.
4. A nonexclusive easement shall be reserved for public utilities purposes in, over
and upon the south 5 feet of that portion of the vacating area lying 128 feet west of the west
line of Elm Street.
5. 7:00 P.M. on Wednesday, March 8, 1995, in the Council Chambers, City Hall,
1501 Truxtun Avenue, Bakersfield, California, is hereby fixed as the time and place when
all persons interested in or objecting to the proposed vacation may appear before the City
Council and be heard.
6. The City Clerk shall cause notice of the date, hour and place of said hearing on
this resolution to be published for two successive weeks prior thereto in the Bakersfield
Californian and the Superintendent of Streets of the City of Bakersfield, California, shall
cause "Notice of Vacation" to be posted as required by Section 8323 of the Streets and
Highways Code of the State of California.
7. The City Clerk shall certify to the passage of this resolution and shall cause the
same to be posted on the bulletin board at the City Hall, 1501 Truxtun Avenue, in the City
of Bakersfield, California, within fifteen (15) days after its passage.

Beginning at the point of intersection the west line of Elm Street
and the north line of the 20 foot-wide alley in Block 461 as shown
on 'Map of the City of Bakersfield, Kern County, California", filed
for record November 25, 1898, in Book 1 of MaDs, at Pages 13 and
14, in the office of the kern County Recorder;
TH~NCR North, 00'00' East, along said west line of Elm Street,
10.00 feet to the northerly line of the additional alley right of
way granted to the City of Bakersfield by deed filed for record in
Book 599, Page 27, Official Records, in the office of the Kern
County Recorder;
TH~NCR North 90'00' West, along said alley right of way line,
162.46 feet;
THRNCR South, 45'00' East, 14.14 feet to a point on the north line
of the original 20 foot wide (east/west) alley in said Block 461;
TH~NC~ South 90'00' East, along said north line, 152.46 feet to the
point of beginning.
