HomeMy WebLinkAboutROI NO 1146RESOLUTION OF INTENTION NO. 1146 A RESOLUTION OF TIlE COUNCIL DECLARING ITS INTENTION TO ORDER TltrE VACATION OF THE PUBLIC STREET RIGHT OF WAY FOR GARLAND AVENUE IN TIlE CITY OF BAKERSFIELD. WHEREAS, J.O. BARBER FAMILY TRUST submitted a request for vacation of the public street right of way for Garland Avenue in the City of Bakersfield; and WItE~REAS, for the above-described project, it was determined that the proposed vacation is exempt from CEQA according to Section 15061(b)(3) in that there is no possibility that the Road Right of Way vacation and proposed use could have a significant effect on the environment; and WItEREAS, at its meeting on April 4, 1996, the vacation was duly heard and considered by the Planning Commission and was found to be consistent with the Metropolitan Bakersfield 2010 General Plan. NOW, THEREFORE BE 1T RESOLVED by the Council of the City of Bakersfield as follows: 1. The above recitals are tree and correct and are incorporated herein. This resolution is adopted pursuant to Division 9, Part 3, Chapter 3 of the Street and Highways Code of the State of California. The Council intends to order the vacation of the public street right of way for Garland Avenue in the City of Bakersfield, County of Kern, State of California and more particularly described as follows: All of the public road right of way for Garland Avenue, in the southwest quarter of Section 13, T. 30 S., R. 27 E., MD.M, City of Bakersfield, County of Kern, State of California, lying east of the east line of the west 55 feet of said quarter section, per road right of way deeds filed for record in Book 2794, Page 230, 231,233 through 238; Book 5770, Page 1624; Book 6649, Page 1941, Official Records in the Office of the Kern County Recorder. A non-exclusive easement shall be reserved for public utilities purposes in, over and upon the entire above described street area. All of or a portion of the reserved public utilities easement (described in item 4) within said street shall terminate and be abandoned as an easement when the applicant provided the following: Relocation of the existing public utilities (including City storm drain facilities) to public utility company standards and acceptance; and Dedication of adequate easements for any relocated public utilities extending through private property with alignments thereof approved by the City and the Utility Companies. 7:00 P.M. on Wednesday, May 8, 1996, in the Council Chambers, City Hall, 1501 Truxtun Avenue, Bakersfield, California, is hereby fixed as the time and place when all persons interested in or objecting to the proposed vacation may appear before the City Council and be heard. The City Clerk shall cause notice of the date, hour and place of said hearing on this resolution to be published for two successive weeks prior thereto in the Bakersfield Californian and the Superintendent of Streets of the City of Bakersfield, California, shall cause "Notice of Vacation" to be posted as required by Section 8323 of the Streets and Highways Code of the State of California. The City Clerk shall certify to the passage of this resolution and shall cause the same to be posted on the bulletin board at the City Hall, 1501 Truxtun Avenue, in the City of Bakersfield, California, within fifteen (15) days after its passage. ...... 000 ......
