HomeMy WebLinkAboutROI NO 0989RESOLUTION OF INTENTION NO. 989 A RESOLUTION OF THE COUNCIL OF THE CITY OF BAKERSFIELD, STATE OF CALIFORNIA, CALLING A PUBLIC HEARING TO DETERMINE WHETHER PUBLIC NECESSITY, HEALTH, SAFETY OR WELFARE REQUIRE FORMATION OF AN UNDERGROUND UTILITY DISTRICT WITHIN DESIGNATED AREA (DISTRICT NO. 2, DIVISION 11). WHEREAS, Chapter 12.32 of the Municipal Code of the City of Bakersfield establishes a procedure for the creation of under- ground utility districts, and requires, as the initial step in such procedure, the declaration and holding of a public hearing to ascertain whether the public necessity, health, safety or gen- eral welfare require the removal of poles, overhead wires and associated overhead structures, and the underground installation of wires and facilities for cable television or similar district; and supplying electric, communication, and associated services in any such WHEREAS, the Planning Commission o~ the City of Bakersfield has heretofore, at a regular meeting thereof, recom- mended that an underground utility district, hereinafter called Underground Utility District Mo. 2, Division 11, De ~ormed in that area, more particularly descriDed as follows: DESCRIPTION DIVISION 11 Beginning at the intersection of the south line of Ming Avenue and the east line o~ WiDle Road; Thence 1) easterly along said south line of Ming Avenue to intersect the east line of Hughes Lane; Thence 2) northerly along said east line of Hughes Lane to intersect the north line o~ Ming Avenue; Thence 3) westerly along said north line of Ming Avenue to intersect the west line ot South Real Road; Thence (4) southerly along said west line of South Real Road to intersect the south line of Ming Avenue; Thence (5) easterly along said south line of Ming Avenue to intersect the west line of Wible Road; Thence (6) southerly along said west line ot W~ble Road to inter- sect the north line of Wilson Road; 3. NOTICE IS FURTHER GIVEN that at such hearing all persons interested shall be given an opportunity to appear and be heard. Said hearing may be continued from time to time as may be determined by the City Council, whose decision shall be ~inal and conclusive. 4. That the City Clerk shall notify all a~fected prop- erty owners as shown on the latest equalized county assessment roll, and the utility companies (utilities), o~ the time and place of such hearing by mailing a copy of this resolution to such property owners and utilities concerned at least ten (1U) days prior to the date of such hearing. 5.
