A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD, CALLING A PUBLIC HEARING TO
DETERMINE Wm~','-K¼ PUBLIC NECESSITY, HEALTH,
SAFETY OR WELFARE REQUIRES FORMATION OF AN
UNDERGROUND UTILITY DISTRICT WITHIN
DESIGNAT~ AREA - DISTRICT NO. 2, DIVISION 21
( KERN RIVER PARKWAY).
WHEREAS, Chapter 12.32 of the Municipal Code of the
City of Bakersfield establishes a procedure for the creation of
underground utility districts, and requires, as the initial step
in such procedure, the declaration and holding of a public
hearing to ascertain whether the public necessity, health, safety
or general welfare requires the removal of poles, overhead wires
and associated overhead structures, and the underground
installation of wires and facilities for supplying electric,
communication, cable television or similar and associated
services in any such district; and
WHEP~EAS, the underground utility district, hereinafter
called Underground District No. 2, Division 21, to be formed is
described as follows:
UNDERGROUND UTILITY DISTRICT NO. 2 DIVISION 21
That area in the City of Bakersfield, State of
California, more particularly described as follows:
A 50-foot wide strip of land in the North 1/2 of
Section 26, Township 29 South, Range 27 East, M.D.M.,
City of Bakersfield, County of Kern, State of
California, and said strip being situated along the
following described center line;
Commencing at the point of intersection of the center
lines of Truxtun Avenue and Empire Drive as shown on
Parcel Map No. 7310 filed in Book 32 of Parcel Maps at
80 in the office of the Kern County Recorder;
Thence North 00°00'07" West, along said Empire Drive
center' line, 278.00 feet to the beginning of a 300.00
foot radius curve, concave to the southeast;
Thence Northeasterly along said centerline curve
through a central angle of 22°13'26'', an arc distance
of 116.36 feet to the center of an existing concrete
monument with a brass cap marked R.C.E. 15331 (per
Parcel Map No. 7310);
Thence, departing said centerline, North 26023'26''
East, 1,027.64 feet to the TRUE POINT OF BEGINNING;
Thence South 84°17'03" West, 660.00 feet to the END
POINT of this description.
NOW, THEREFORE, BE IT ItESOLVED by the Council of the
City of Bakersfield as follows:
1. NOTICE IS IIEREBY GIVEN that the public hearing
will be held by and before the City Council of the City of
Dakersfield on WED1F~$DAYt JULY 25t 1990, at the hour of 7:00
p.m., or as soon thereafter the matter may be heard, in the
Council Chambers of the City Hall at 1501 Truxtun Avenue,
Bakersfield, California, to ascertain whether public necessity,
health, safety or welfare required the removal of poles, overhead
wires and associated overhead structures, and the underground
installation of wires and facilities for supplying electric,
communication, cable television or similar and associated
services in the Underground Utility District No. 2, Division 21,
hereinabove described.
2. NOTICE IS FURTHER GIVE~ that should District No.
2, Division 21, be formed, all existing overhead communication
and electric distribution facilities therein shall be removed in
accordance with the provisions of Chapter 12.32 of the Municipal
Code of the City of Bakersfield and the Resolution intended and
proposed to be adopted, establishing such District No. 2,
Division 21, at no expense to any property owner served from such
overhead distribution facilities.
3. NOTICE IS FURT~ GIVEI~ that at such hearing all
persons interested shall be given an opportunity to appear and be
heard. Said hearing may be continued from time to time as may
determined by the City Council, whose decision shall be final and
conclusive.
4. That the City Clerk shall notify all affected
property owners as shown on the latest equalized County
assessment roll, at the utility companies (utilities), of the
time and place of such hearing by mailing a copy of this
~esolution to such property owners and utilities concerned at
least ten (10) day prior to the date of such hearing.
5. The area proposed to be included in District No.
2, Division 21 (described above) is shown upon that certain map
or diagram in the office of the City Clerk of the City of
Bakersfield, which map or diagram is entitled "Underground
Utility District No. 2, Division 21."

I ~IEREBY CERTIFY that the foregoing Resolution was
passed and adopted by the Council of the City of Bakersfield at a
regular meeting thereof held on jUN ~ 7 1§90 , by the
