BE IT RESOLVED BY TW,_~I COU~'CIL OF TME CITY OF BAKERSFIELD,
That it is the intention of taw City Council of the Clty of
Bakersfield to order t~e followir~ work to be done and improvement to
be made in the said City, to-wit:
That taw grades o~ that oortion of Sumner Street, from Beale
Avenue to lW, aley Street inclueive, be charged and re-established from
taw official grades, to the grades proposed therefor wnica prooosed
~rades are f~lly setfortn and shown on the plans, and which plans are
row on file in the office of the City Clerk of the City of Bakersfield
and are hereby specificslly referred to for further and complete parti-
culars regarding the proposed grades for ~aid portion of Sumner Street.
That a strip twenty-six (26) feet wide along and thirteen (1~)
feet on either side of the hereinafter described line, on Samner Street,
be graded and that a strip eighteen (18) feet wide and nine feet
(9) on either side of said line be paved with a four (4) inch asphalt
concrete base and a one and one-aalf (l~) inch Warrenite-Bitulitnic
wearing surface. Eaid line being described as follows: Beginning
at taw intersection of the center line of Sumner Street with the
easterly line o f Kirg.~ Street sr~ r~n~in~ thence easterly alo mrg the
center line of Sumner ~treet to the beginrin~ of a curve at a point
7.10 feet westerly from taw westerly line of Haley Street; thence to the
right along said curve, whose radius is 164.98 feet a distance of
91.76 feet; thence southeasterly along the center line of Sumner ~treet
437.~8 feet to the beginning of a curve whose radius is 193.19 feet;
thence to the left along said curve a distance of 152.69 feet to a
point in the center line of East Truxtun Avenue; taence easterly along
the center lire of East Truxtun Avenue to a point 4.38 feet westerly
from the easterly city limits of the City of Bakersfield, excepting
a~d ezcludirg such portions thereof as are required by law, to be
paved, kept in order or repair by any person or company navirg railroad
or car tracks thereon; also
That cement concrete c~verts be constructed across the pave-
merit on said S~ner Street at Beale Avenue, G~e Street a~d Haley Street
a~ at the te~inatior of S~er Street in East Tr~tun Avenue.

and specifications are on file in the office of the City, Clerk
ef the ~ity of B~ersfield, and are hereby referred to and by suc~ re-
ference ~de a part and ~rtio~ hereof, and in this connection the said
plans and specifications also saow the exact locatio~ of the afores~d
work andimprovement.
The pavi~ work aforesaid sn~l be done ~lso in accordance
with the te~s and conditions set forth in the Warrenite-Bitulitnic
License Mixture ~reement, entered into by said City Council with the

layi~ of a pavement for which United States Letters Patent are held
by said Compaq, w~icn Warrenite-Bitulitnic License Mixture ~reement
is also on file in the office of said City Clerk and is hereby referred

to be procured of said Warren Brothers Company as provi'ded in said
Warrenite-Bitulitnie License Mixture ~reement.
A~ Whereas, said contemplated work a~d improvement, in the
opinion of the said City Council is of more than local or ordina~
public benefit, said council aereby m~es the e~sts and expemse of
said work ar~l improvement chargeable as follows:
That the sum of fifteen thousand ($15,000.00) dollars be paid
out of the treasury of the City of Bakersfield from the general fund
for the purpose of defraying a part of the costs and expenses of the
nereinabove mentioned improvement, provided however that the above-
mentioned sum shall not be paid until after the contractor nas ful-
filled' his contract to tne satisfaction of the Street Superintendent
of the City of Bakersfield; said
And +mat tne balance of the costs and expenses of/improvement be
assessed upon a district, which district said City Council hereby
declares to be the district benefitted by said work and improvement
and which said district is bounded and described as follows:
Beginning at a point in the easterly city limits of the
City of Bakersfield 150.15 feet southerly from the southerly line of
East Truxt,~n Avenue and running thenCe westerly on a line 150 feet
southerly from and parallel to the southerly line of East Truxt~n
Avenue to the westerly line of lot 8, Block 101, as said lot and
block are ShOWn on W. C. Parson's amended Map Number 2; thence
northerly along the westerly line of said lot 8 and the extension
northerly thereof to the southerly line of East Truxtun Avenue; thence
northwesterly o~n a straight line to a point in the westerly line of
Haley Street 150 feet southerly from the southerly lin~ of Sumner
Street; thence westerly on a line 150 feet southerly from and parallel
to.the southerly line of Sumner ~treet to the easterly line of King
Street; thence northerly along, the easterly line of King Street and
the extension northerly thereof to a point 150 feet northerly from
the northerly line of Sumner Street; thence easterly alor~ a line
150 feet northerly from and parallel to the norther? line of
Sumner Street to its intersection with a line 150 feet northeasterly
from and parallel to the northeasterly line of that portion of Sumner
Street designated by Ordinance ~o. 49 }~ew Series, of the Council of
the City of Bakersfield, adopted May lOth0 1920; thence southeasterly
on said line 150 feet northeasterly from and parallel to the north-
easterly line of said portion of ~umner ~treet, last above described,
to itc intersection with a line l~O feet northerly from and parallel
to the northerly line of East Truztun Avenue; thence easterly on a
line l~O feet northerly from and ~arallel to the northerly line of
East Truxtun Avenue to the easterly City Limits of the City of
Bakersfield; thence southerly along said easterly City Limits to the
point of beginning. Ail in the City of Bakersfield, California.
Notice is hereby given that serial bonds to represent unpaid
assessments, and bear interest at the rate of seven (7~) per cent per
annum will be issued hereunder in the manner provided by the Improve-
ment Bond Act of 1915, and all acts amendatory thereof, the last
installment of W~icn bonds^mature nine years from the 2nd day of July
next succeeding nine months from their date.
E¥cept as nereinabove otherwise provided for the issuance
of said serial bonds, all of t~e herein proposed work shall be done
in pursuance of an act of the Legislature of the State of California,
designated the Improvement Act of 1911, approved April 7tn, 1911, and
all acts amendatory thereof.
Notice is ~ereby ~iven that on Monday the /~ .~day of
~-~~ , 1922, at 8 o'clock P.M. at the regular meeting of tna
said City Council in the Council Chambers of said City Council in the
City Hall of the City of Bakersfield, any and all persons having any
objections to the proposed work or improvement may appear before
said City Council and snow cause why said proposed improvement should
not be carried out in accordance with said Resolution.
The City Clerk of said City of Bakersfield shall cause this
Resolution of Intention to be published twice in the THE BAKERSFIELD
CALIFOR~IAN, ada. ily newspaper printed, published and circulated in
said City of Bakersfield, and hereby designated for that purpose by
said City Council.
The ~treet Superintendent of said City of Bakersfield shall
cause to be conspicuously posted along the line of said contemplated
work and improvement and along all the open streets within said dis-
trict, notice of the passage of this Resolution of Intention, in the
