Dennis Fox spoke regarding weeds growing at Hart Park and flowing down the river and the use of spray pesticides. i' l - I`_� A. Provisionally Accredited Levees. Mark Lambert, Water Resources Superintendent, stated the City has entered into an agreement with the Federal Emergency Management Agency (FEMA) and has acquired a $200,000 grant to fund the hydraulic analysis study. Activity will take place along the Kern River Channel and on the levee as the study is completed. No action taken. REPORTS A. Kern River & Isabella Reservoir Operations Report. Steve Lafond, Hydrographic Supervisor, gave a brief update and provided a 24 hour precipitation summary. Mr. Lafond distributed the April /July 2009 Kern River snow melt and run -off report. A chart showing the depth to water in the City's 2300 acre municipal water bank reflects the low water level conditions the City is experiencing. The pumping has been lowered over a 100 feet. A good winter is needed. No action taken. Water Resources Manager Florn Core announced this may be Steve Lafond's last meeting. Mr. Lafond has announced his retirement will be on December 30, 2009. Bakersfield, California, October 14, 2009 — Page 2 A. Letter to Urban Water Purveyors within City on Availability of Kern River water. Florn Core, Water Resources Manager, stated tha Ag water contracts will expire in December of 2011. This letter is to initiate negotiations between the City and the purveyors to determine when and the quantity of water the purveyors may need. Information only, no action taken. 8. NEW BUSINESS A. Participation in Kern River Weather Modification Program for 2009/2010 Season. Florn Core, Water Resources Manager, stated this is an annual contract between North Kern Water Storage District and RHS Consulting. The contract proposes changes in billing, reducing the monthly charge and an increase in flying time. The cost is shared with North Kern, Kern Delta and Buena Vista Water Districts and the City of Bakersfield. Motion by Scrivner to approve City participation in the Kern River Weather Modification Program for 200912010 Season in the amount of $50,000. B. Independent Contractor's Agreement with Trans -West Security to Provide Security Patrol Services for City Water Facilities. Maurice Randall, Business Manager, stated this agreement will enable Trans - West Security to continue to provide security patrol services in the City's 2800 Acres and other river facilities; and requested the Board approve the agreement for a two year period in the amount of $40,000. Motion by Hanson to approve Agreement No. 09 -05WB with Trans -West Security to provide Security Patrol Services for City Water Facilities. APPROVED ALL AYES C. Agreement with Live Oak Associates for biological services. Maurice Randall, Business Manager, stated this agreement is to complete the fifth year of Buena Vista Lake Shrew habitat monitoring report. Florn Core, Water Resources Manager, stated Live Oak is monitoring the designation of the Buena Vista Lake Shrew habitat. The U.S. Fish and Wildlife Service have settled a lawsuit with the Center for Biological Diversity and will be re- designating five areas in Kern County on critical habitat for endangered species. The City's 2800 Acres will be one of the areas re- designated. If the area is designated as critical habitat for the Buena Vista Lake Shrew habitat the area would require federal rules and regulations. Motion by Hanson to approve Agreement No. 09 -04WB with Live Oak Associates in the amount of $12,000 for year five. APPROVED, ALL AYES. Bakersfield, California, October 14, 2009 — Page 3 8. NEW BUSINESS continued D. Domestic Water Mainline Extension 'Refund Agreement Assignment. Maurice Randall, Business Manager, stated one water mainline extension refund agreement assignment was received requesting the City assign the contract payment to another individual at no increase of cost to the City. Fifteen years remain on the agreement. Information only, no action taken. E. Agreement with California Water Service Company for Providing Emergency Residential Water Line Repairs. Florn Core, Water Resources Manager, stated Cal Water is offering homeowners insurance for waterline repairs from the curb to the house. Cal Water is requesting to use the City's data base. Cal Water will contact customers by letter. The City is not endorsing the process, other than allowing Cal Water the use of names and addresses. Cal Water will keep customer account information confidential. There is no privacy violation. Vice -Chair Hanson asked who should be called regarding repair of leaks in roadways. NEW BUSINESS January 20, 2010 A. Independent Contractor's Agreement with Stetson Engineers, Inc. for Engineering Services related to Urban Water Planning and Water Needs Studies — For Board Review and Action II Er INDEPENDENT' GO'NVI°RACTOR`S AGREEMENT THIS AGRFF_`MENT is made ,=,nd entered into n n and between the CITY OF l AKERa'�'-IELD, a municipal corporation, ( "CV1Y" herein) and STETSON ENGINEERS INC, ( "COl 1_'- RACTOR" herein). RECITALS WHEREAS, CONTRACTOR represents CONTRACTOR is experienced, well qualified and a specialist in the field of preparing an update for the 2010 Urban Water Management Plan; and NOW, THEREFORE, incorporating the foregoing recitals herein, CITY and CONTRACTOR mutually agree as follows: 1, SCOPE OF WORK. The scope of work is described as: preparation of 2010 update to the Urban Water Management Plan (UWMP) for both the City's Wholesale and Retail Water Systems in accordance. The scope of work shall include all items and procedures necessary to properly complete the task CONTRACTOR has been hired to perform, whether specifically included in the scope of work or not. 2, COMPENSATION. Compensation for all work, services or products called for under this Agreement shall consist of a total payment of Thirty -One Thousand Dollars ($31,000.00) which shall be paid for completed services after receipt of an itemized invoice approved by the Water Resources Manager or his designee. The compensation set forth in this section shall be the total compensation under this Agreement including, but not limited to, all out -of- pocket costs and taxes. CITY shall pay only the compensation listed unless otherwise agreed to in writing by the parties. 3. PAYMENT PROCEDURE. CONTRACTOR shall be paid for services rendered after receipt of an itemized invoice for the work completed and approved by CITY in accordance with the terms of this Agreement. Payment by CITY to CONTRACTOR shall be made within thirty (30) days after receipt and approval by CITY of CONTRACTOR's itemized invoice. 4. KEY PERSONNEL, CONTRACTOR shall name all key personnel to be assigned to the work set forth herein. All key personnel shall be properly licensed and have the experience to perform the work called for under this Agreement. CONTRACTOR shall provide background for each of the key personnel including, without limitation, resumes and work experience in the type of work called for herein. CITY reserves the right to approve key personnel. Once the key personnel are approved CONTRACTOR shall not change such personnel without the written approval of CITY. NO WAIVER OF DEFAULT. The failure of any party to enforce against another party any provision of this Agreement shall not constitute a waiver of that party's right to enforce such a provision at a later time, and shall not serve to vary the terms of this Agreement. 8, LICENSES. CONTRACTOR shall, at its sole cost and expense, keep in effect or obtain at all times during the term of this Agreement any licenses, permits and approvals which are legally required for CONTRACTOR to practice its profession. If a corporation, at least one officer or key employee shall hold the required licenses or professional degrees. If a partnership, at least one partner shall hold the required licensees or professional degrees. 9. STANDARD OF PERFORMANCE. All work shall be performed in conformity with all legal requirements and industry standards observed by a specialist of the profession in California. 10. MERGER AND MODIFICATION. This contract sets forth the entire Agreement between the parties and supersedes all other oral or written representations. This contract may be modified only in writing and signed by all the parties. If any modification of this Agreement results in total compensation which exceeds Forty Thousand Dollars ($40,000.00), such modification must be approved by the City Council. 11. EXHIBITS. In the event of a conflict between the terms, conditions or specifications set forth in this Agreement and those in exhibits attached hereto, the terms, conditions, or specifications set forth in this Agreement shall prevail. All exhibits to which reference is made in this Agreement are deemed incorporated in this Agreement, whether or not actually attached. 12. TERM. Unless terminated sooner as set forth herein, this Agreement shall terminate on December 1, 2010 (date). 13. TERMINATION. This Agreement calls for the performance of the services of CONTRACTOR as an independent contractor. CONTRACTOR is not an agent or employee of the CITY for any purpose and is not entitled to any of the benefits provided by CITY to its employees. This Agreement shall not be construed as forming a partnership or any other association with CONTRACTOR other than that of an independent contractor. 16. DIRECTION. CONTRACTOR retains the right to control or direct the manner in which the services described herein are performed. 17. EC0U PMENT. CONTRACTOR will supply all equipment, tools, materials and supplies necessary to perform the services under this Agreement. 18. INSURANCE. ISA All policies required of the CONTRACTOR shall be primary insurance as to the CITY, its mayor, council, officers, agents, employees, or designated volunteers and any insurance or self-insurance maintained by the CITY, its mayor, council, officers, agents, employees, and designated volunteers shall be excess of the CONTRACTOR's insurance and shall not contribute with it. 18.5 Except for workers' compensation, insurance is to be placed with insurers with a Best's rating as approved by CITY's Risk Manager, but in no event less than A-VII. Any deductibles, self-insured retentions or insurance in lesser amounts, or lack of certain types of insurance otherwise required by this Agreement, or insurance rated below Best's A-:VII, must be declared prior to execution of this Agreement and approved by the CITY in writing. 18.6 Unless otherwise approved by CITY's Risk Manager, all policies shall contain an endorsement providing the CITY with thirty (30) days written notice of cancellation or material change in policy language or terms. All policies shall provide that there shall be continuing liability thereon, notwithstanding any recovery on any policy. Copies of policies shall be delivered to CITY on demand. 18.7 The insurance required hereunder shall be maintained until all work required to be performed by this Agreement is satisfactorily completed as evidenced by written acceptance by the CITY. 18.8 The CONTRACTOR shall furnish the City Risk Manager with a certificate of insurance and required endorsements evidencing the insurance required. The CITY may withdraw its offer of contract or cancel this contract if certificates of insurance and endorsements required have not been provided prior to the execution of this Agreement. 18.9 Full compensation for all premiums which the CONTRACTOR is required to pay on all the insurance described herein shall be considered as included in the prices paid for the various items of work to be performed under the Agreement, and no additional allowance will be made therefor or for additional premiums which may be required by extensions of the policies of insurance. CITY shall approve in writing all such security instruments prior to commencement of any work under this Agreement. 19, THIRD PARTY CLAIMS. In the case of public works contracts, CITY will timely notify CONTRACTOR of third party claims relating to this contract. CITY shall be allowed to recover from CONTRACTOR, and CONTRACTOR shall pay on demand, all costs of notification. 20. INDEMNITY. CONTRACTOR shall indemnify, defend, and hold harmless CITY, its officers, agents and employees against any and all liability, claims, actions, causes of action or demands whatsoever against them, or any of them, before administrative or judicial tribunals of any kind whatsoever, arising out of, connected with, or caused by CONTRACTOR, CONTRACTOR's employees, agents, independent contractors, companies, or subcontractors in the performance of, or in any way arising from, the terms and provisions of this Agreement whether or not caused in part by a party indemnified hereunder, except for CITY's sole active negligence or willful misconduct. 21. EXECUTION. This Agreement is effective upon execution. It is the product of negotiation and all parties are equally responsible for authorship of this Agreement. Section 1654 of the California Civil Code shall not apply to the interpretation of this Agreement. 22. NOTICES. All notices relative to this Agreement shall be given in writing and shall be personally served or sent by certified or registered mail and be effective upon actual personal service or depositing in the United States mail. FUR THIER ASSURANCES. Each party shall execute and deliver such papers, documents, and instruments, and perform such acts ac-, are necessary of appropriate, to implement the terms of this Agreement and the intent of the parties to this Agreement. 25. ASSIGNMENT. Neither this Agreement, nor any interest in it may be assigned or transferred by any party without the prior written consent of all the parties. Any such assignment will be subject to such terms and conditions as CITY may choose to impose. 26. BINDING EFFECT. The rights and obligations of this Agreement shall inure to the benefit of, and be binding upon, the parties to the contract and their heirs, administrators, executors, personal representatives, successors and assigns, and whenever the context so requires, the masculine gender includes the feminine and neuter, and the singular number includes the plural. This Agreement may be executed in any number of counterparts, each of which shall be considered as an original and be effective as such. 27. TITLE TO DOCUMENTS. All documents, plans, and drawings, maps, photographs, and other papers, or copies thereof prepared by CONTRACTOR pursuant to the terms of this Agreement, shall, upon preparation, become the property of the CITY. 28. ACCOUNTING RECORDS. CONTRACTOR shall maintain accurate accounting records and other written documentation pertaining to all costs incurred in performance of this Agreement. (Stetson) is pleased to submit this Proposal to the City of Bakersfield (City) for the preparation of the 2010 update to the Urban Water Management Plan (UWMP) for both the City's wholesale water system and the retail water system. The wholesale UWMP was last updated in July 2003 while the retail UWMP was last updated in November 2007. In accordance with the Urban Water Management Planning Act, Sections 10617 and 10621 of the California Water Code (enclosed as Attachment A), each urban water supplier providing water for municipal purposes either directly or indirectly to more than 3,000 customers or supplying more than 3,000 acre -feet of water annually, shall prepare, update and adopt its urban water management plan at least once every five years on or before December 31, in years ending in five and zero. The 2010 update to both of the UWMPs is due no later than December 31, 2010. The California Department of Water Resources (DWR), Office of Water Use Efficiency and Transfers (OWUE) website indicated "it is likely that the 2010 UWMP Guidebook will be available in late 2009 or early 2010." More recently Stetson was advised the 2010 Guidebook may not be available until early spring 2010. Consequently, unless new legislation is enacted, the requirements for the 2010 UWMP update are essentially the same as the 2005 UWMP. However, as the result of any new legislation changing the requirements included in the 2010 UWMP Guidebook, amendments to the Scope of Work of this Proposal may be necessary. The California Water Code, Article 2, ( §10631- 10635) requires the UWMP to include the following basic items: A description of the service area; Mr. MaF Dec(, - m!,) Page 2 A description cif the existing and plam-ied sources of Supply and the reliability of those sources during an average water year, a single dry year and multiple dry years; A description of existing groundwater management activities; A description of opportunities for exchanges or transfers of water; Historic and projected water use; A description of Demand Management Measures; Discussion of an Urban Water Shortage Contingency Plan and analysis; ® Discussion of the opportunity to use recycled water. Each of these requirements is addressed in the tasks listed under the "Project Approach" heading in this Proposal. Separate reports will be prepared for the wholesale and retail UWMPs. Water suppliers are required to coordinate the preparation of the UWMP update with other water suppliers and appropriate agencies in the area. All water suppliers are required to notify cities and counties in their service area of the opportunity to submit comments regarding the UMWP during the update process. A copy of the draft 2010 UWMP plan must be made available for public review during normal business hours and the urban water supplier is required to provide cities and counties 60 days notice of a Public Hearing. As a wholesale supplier your customers may refer to your UWMP and water supply reliability to develop their UWMPs. Retail suppliers which receive water from the City wholesale water system will need to complete a draft UWMP by the end of September in order to adopt those plans by December 2010. Consequently, it is suggested the City's wholesale water system draft UWMP should be made available for public review no later than June 2010. Water suppliers are required to file their UWMPs, or amendments thereto, with the DWR and any City or county within which the supplier provides water, no later than 30 days after adoption. UWMPs are reviewed by DWR staff to determine compliance with the requirements of the Urban Water Management Planning Act. Results of the DWR review are provided to urban water suppliers through a review letter. DWR provides a Legislative Report to the California Legislature summarizing the status and outstanding elements of the UWMPs. PROJECT UNDERSTANDING The Urban Water Management Planning Act was established by Assembly Bill 797 in 1983 and amended on numerous occasions; most recently in 2004. In particular, Assembly Bill 11X amended the Urban Water Management Planning Act by including a requirement for a Water Shortage Contingency Plan in 1991. Mr. Dark Lambert December 11, 2009 Page 3 Several amendments have been made to the Urban Water Management Planning Act. Section 10631(b) has been expanded to require additional information on groundwater basin management and reliability of supply. Section 10631 (h & i) were added and requires additional information on water supply projects, including the use of desalination. Emphasis on the potential use of recycled water is also included in Section 10633. Stetson's goal is to develop seperate UWMPs for both the City of Bakersfield wholesale and retail Water System that addresses all aspects of the UWMP including a description of the water system; past, present and proposed water demands; sources of supply; existing water conservation activities; a water shortage contingency plan; and potential use of recycled water. Stetson intends to provide the City of Bakersfield with two seperate up -to -date, comprehensive UWMP that meets all of the State's requirements. Stetson has outlined the following principal work tasks and deliverables that are applicable to both UWMPs. Task CoUlcct and Review AvaHaNe Data (Section 106311 a,b,c,d,c9 10636) Prior to beginning work, Stetson, and the City of Bakersfield staff will hold a kickoff meeting to develop schedules, review the 2005 UWMP submitted to DWR and discuss areas requiring update, obtain water system data, identify critical work items, establish Stetson -City of Bakersfield staff coordination, and plan and coordinate the general execution of the work. Stetson will review the existing data on the City of Bakersfield Wholesale and Detail water systems including water supply and demand, water conservation programs, water use restrictions and ordinances, and water system revenues and expenses. Stetson will utilize information already compiled and included in the 2005 UWMP and make appropriate modifications to expedite the 2010 UWMP update process. Stetson will evaluate water supply reliability. Stetson will review the 2005 UWMP and update the one -year and three -year worst -case water supply scenarios as appropriate. In addition, Stetson will review the potential availability and use of recycled water. Task 2 Evaluate Water Demand fanageent Measures (Section 10631 Stetson will evaluate the City of Bakersfield wholesale and retail water system existing water demand management measures and ordinances with particular emphasis to those measures listed under Section 10631 (f)(1) of the Urban Water Management Planning Act. All water demand management measures listed in the Urban Water Management Planning Act will be addressed in the UWMPs. Stetson will work with the City of Bakersfield staff to identify other demand management measures which potentially may be implemented. Task 3 Review and Evaluate Potential Water Sources (Section 10631 i; Section 10633) Stetson will work with the City of Bakersfield staff to evaluate the potential for development of desalinated water and evaluate the potential use of recycled water. Stetson will investigate potential sources of recycled water and will work with the City of Bakersfield staff to develop a list of potential uses of recycled water. Task 4 Update Water Shortage Contingency Plan (Section 10632) Stetson will review the City of Bakersfield wholesale and retail water system Water Shortage Contingency Plan. Stetson will compare projected water demands to worst -case water supply scenarios to identify potential water supply shortages. Stetson will work with the City of Bakersfield staff to develop water shortage stages of action, water use reduction goals for each stage, and water use restrictions. Stetson will provide general revenue and expenditure analysis to evaluate potential revenue decreases during water conservation periods. Stetson will work with the City of Bakersfield staff to develop mechanisms to measure actual water conservation. Stetson will assist with preparation of a draft resolution adopting the Water Shortage Contingency Plan including provisions to implement the Water Shortage Contingency Plan.
