Re: Cabaret application for 3000 Mall View Rd C -103.
Mr. Garcia:
The Bakersfield Planning Department has denied your application for a cabaret
permit. You were informed in late October that the maximum permissible
occupancy of the food court area beyond your tenant space is 50 persons. You
informed the Planning Dept. you were uncertain whether or not you would
precede with the application. Since then you have not given the City of
Bakersfield any indication of your decision and the time for processing the
application has lapsed.

Lt. West,
Here is the information I talked to you about regarding the East Hills Mall. Grand Image Photography
was one of the business at the East Hills Mall having functions possibly outside their business license. The night of the
Rap concert at Rabobank Arena there was a dance being held at East Hills Mall. Grand Image was having the function
with the D1 business directly across from them inside the mall. We contacted Charles Wells with a DOB of 12/11/1984
and CDL D2826523 whom is associated with Grand Image Photography.
12/18/11 Officer Dixon conducts a vehicle stop and identify the occupants of the vehicle. The occupants
tell Officer Dixon they came from a RAP BATTLE at the East Hills mall. The Rap Battle was held at Grand Image
Photography. Officer Messick went to the East Hills Mall and spoke to another tenant. The tenant who wish to remain
anonymous told Officer Messick that the Grand Image photography held a dance last night at their location. There were
numerous subjects present. The tenant stated the subjects are using the North side entrance to access the mall. The
tenant further stated Grand Image Photography is advertising their events on Facebook flyers using the name as Bako
Stars.
Officer Messick conducted an internet search on Facebook using the name Bako Stars. He was able to
confirm the information provided by the tenant. It did not provide the address to their location, however it has a picture
of the East Hills Mall and give directions to the mall. It advertise that it will promote parties, rap battles, serve food and
drinks including alcohol for the 21 and over crowd.
I conducted a Versadex search on Wells. We have quite a few contacts with him, but most of it are
minor things. He was associated or owner of a place called "Pulse Nt Club." It was located at 2001 Chester Avenue. I
believed this was and 18 and over night club that someone eventually shut down for unknown reason. It seems to me
that Mr. Wells may be operating or assisting in these functions outside their business license and permit. Sgt. Heredia

Yes, I believe DJ N is the business that was planning the last "public dance ". I provided Captain Bianco information
related to the permit requirements and process for "public dance" and "Cabaret ". I also discussed the matter with Sgt.
Heredia. Per Drew Shaples with the Treasury Division, no one has applied for a "public dance" permit in the last two
years.
I believe it is just a matter of time before they have an "unpermitted" event. Hopefully we will eventually have enough
documentation to site the ownership (Nick) for impeding the exit corridors and /or some occupancy related violation. I
think he is condoning if not promoting this use of the mall.

I visited the EH mall yesterday, met with Nick, told him I was taking a look -see about the stage activities in Center
Court. I told him there's a Cabaret Permit required anytime there's alcohol & music together in the same occupancy &
that I had concerns about Pizza Bob's beer sales going on across form this stage.
Nick also showed me the Mall- operated Banquet Suite, still under construction, still needing Handicap restrooms,
etc. That worries me it could still be used, even though unfinished.
However, my radar really blipped when I saw the DJ's Suite set up like a dance hall. I think that's our clandestine night
club after the Mall closes. Does this fit Sgt. Herredia's report?
