Noticed Public Hearing to receive comment on the City of Bakersfield 2008 Wholesale Urban Water Management Plan. Mark Lambert, Water Resources Superintendent, stated the City has prepared a Wholesale Urban Water Management Plan as required by the California Urban Water Management Act. Water purveyors within the City were notified of the preparation of the plan and public hearing. The City currently provides wholesale water to California Water Service Company and the City's Domestic service system. Hearing opened at 2:04 p.m. No comments. Hearing closed at 2:05 p.m. Motion by Scrivner to approve the 200: Wholesale Urban Water Management Plan and authorized staff to forward to the State_ APPROVED ALL AYES, r.5. Mark Lambert, Water Resources Superintendent, stated staff will be providing FEMA with an update. No action taken. A. Kern River & Isabella Reservoir Operations Report. Steve Lafond, Hydrographic Supervisor, gave an update and provided copies of the 2007 Kern River Annual Report. Vice - Chairman Hanson recognized Dennis Fox, who spoke regarding cloud seeding. Motion by Scrivner to authorize staff to forward copies of the 2007 Kern River Annual Report to the Mayor and full City Council. APPROVED ALL AYES, COUCH ABSENT 8. DEFERRED BUSINESS None. 9. NEW BUSINESS A. Sand Removal Agreement with Granite Construction Company. Motion by Scrivner to approve Agreement No. 08 -20WB with Granite Construction Company. APPROVED ALL AYES, COUCH ABSENT B. Domestic Water Mainline Extension Refund Agreement Assignment Maurice Randall, Business Manager, stated a request to assign a domestic water line extension refund contract to Neptune Company for the assigned outstanding balance of $18,000 was received. Payments are made once a year at no additional cost to the City. No action taken. C. Resolution Approving an Application for Grant Funds for a Local Levee Evaluation Project under Proposition 84. Maurice Randall, Business Manager, stated the resolution authorizes the City to apply for grant funds to complete an evaluation of the Kern River levees. NEW BUSINESS September 10, 2008 A. Assignment and Consolidation of Agricultural Water Contracts for Kern - Tulare and Rag Gulch Water Districts — For Board Approval and Recommendation to City Council AGREEMENT NO. WATER BOARD AGREEMENT NO. 06 -21WB AMENDMENT NO. 1 TO AGREEMENT 76 -61 AND 76 -63 RE: ASSIGNMENT AND CONSOLIDATION OF AGRICULTURAL WATER CONTRACTS. THIS AMENDMENT TO AGREEMENT NO. 76 -61 and 76.63 is made and entered into on , by and between the CITY OF BAKERSFIELD, a municipal corporation ( "CITY" herein), KERN - TULARE WATER DISTRICT, a California Water District and public corporation ( "KERN- TULARE" herein) and RAG GULCH WATER DISTRICT, a California Water District and public corporation ( "RAG GULCH" herein). RECITALS WHEREAS, KERN - TULARE and RAG GULCH are proposing to consolidate under the California Government Code and have initiated proceedings with the Kern County Local Agency Formation Commission; and WHEREAS, the reason for the consolidation proposal is that KERN - TULARE and RAG GULCH currently share a common distribution system, management and staff, yet are governed by two separate boards of directors and all costs of operation are accounted for separately. Consolidation will result in a substantial savings of staff time and operating costs; and WHEREAS, KERN - TULARE is to be designated as the surviving special district and is to succeed to all rights, duties, and obligations of RAG GULCH; and WHEREAS, KERN - TULARE has Agreement No. 76 -61, entitled "Agreement for the Sale of Kern River Water" with CITY for the delivery of 20,000 acre -feet per year of Kern River water; and WHEREAS, RAG GULCH has Agreement No. 76 -63, entitled "Agreement for the Sale of Kern River Water" with CITY for the delivery of 3,000 acre -feet per year of Kern River water; and WHEREAS, it is the intention of the parties hereto to have RAG GULCH assign, and KERN TULARE accept, all of the rights, duties, and obligation under Agreement No. 76 -63 to KERN - TULARE; and WHEREAS, Agreement No. 76 -61 and Agreement No. 76 -63 provide that no assignment of agreements or nor any part may be assigned without the prior written consent of CITY. The rights and obligations of this Agreement shall inure to the benefit of, and be binding upon, the parties to the contract and their heirs, administrators, executors, personal representatives, successors and assigns, and whenever the context so requires, the masculine gender includes the feminine and neuter, and the singular number includes the plural. This Agreement may be executed in any number of counterparts, each of which shall be considered as an original and be effective as such. In the event of a conflict between the terms, conditions or specifications set forth in this Agreement and those in exhibits attached hereto, the terms, conditions or specifications set forth in this Agreement shall prevail. All exhibits to which reference is made in this Agreement are deemed incorporated in this Agreement, whether or not actually attached. 8. MERGER AND MODIFICATION. This contract sets forth the entire Agreement between the parties and supersedes all other oral or written representations. This contract may be modified only in a writing approved and signed by all the parties. 9. CONFLICTS OF INTEREST. KERN - TULARE and RAG GULCH stipulate that corporately, or individually, the districts, their employees and directors have no financial interest in either the success or failure of the consolidation and assignment pursuant to this Agreement. 10. CORPORATE AUTHORITY. Each individual signing this Agreement on behalf of entities represents and warrants that they are, respectively, duly authorized to sign on behalf of the entities and to bind the entities fully to each and all of the obligations set forth in this Agreement. 11. COMPLIANCE WITH ALL LAWS. KERN - TULARE and RAG GULCH shall, at the districts' sole cost, comply with all of the requirements of Municipal, State and Federal authorities now in force, or which may hereafter be in force, pertaining to this Agreement, and shall faithfully observe in all activities relating to or growing out of this Agreement all Municipal ordinances and State and Federal statutes, rules or regulations and permitting requirements now in force or which may hereafter be in force. 12. EXECUTION. This Agreement is effective upon execution. It is the product of negotiation and all parties are equally responsible for authorship of this Agreement. Section 1654 of the California Civil Code shall not apply to the interpretation of this Agreement. In 20079 the SCWC efforts led to.... Passage of Proposition IE. The SCWC supported Proposition 1 E, a $4.1 billion general obligation bond for various flood management programs, with $3 billion to evaluate, repair and restore existing levees in the Delta. Proposition 1 E was passed by the voters, however, even with this spending, the SCVVC remains concerned about the ultimate vulnerability of the levees. Passage of Proposition 84. The Safe Drinking Water, Water Quality and Supply, Flood Control, River, and Coastal Protection Bond Act of 2006, was approved by the voters. Proposition 84 provides $5.4 billion to address water supply needs and protect natural resources. Recommendations on nineteen federal legislative measures and forty-eight (bills authored by California members of the Assembly and Senate. The SCWC reviewed and considered legislative measures ranging from flood control, the Sacramento -San Joaquin Delta, water conservation, water quality, water rights, water supply, groundwater, endangered species and habitat restoration. Positions of support or opposition was based on SCWC policy. Review, analyze and track water - related legislation. The SCWC will base their recommendations on SCWC policy developed by the SCWC Board of Trustees. Testify at hearings involving legislation important to the dater Committee. The SCWC will work with staff consultants on the legislative water committees to ensure that the SCWC's voice is heard in the development of legislation. Informs SCWC members about pending legislation. The SCWC will draft letters for them to communicate directly to legislators Collaborate with other stakeholder groups. It is the SCWC `s intention to develop consensus on pending legislative initiatives. Advocote for a Delta Vision Program that protects the State Water Project and water supply for Southern California. A vision for the Delta must focus on the urgent need to protect the State Water Project and the hater supply for Southern California from the effects of probable levee failure and endangered fish species decline. A Delta Vision must include: (1) Immediate implementation of emergency preparedness actions to limitthe potential of water supply shortages that would result from seismic events or major floods. A catastrophic event would seriously disrupt California's $1,6 trillion economy and the water supply for 26 million Californians. Pro- positioning rock stockpiles, sheet pile, and other necessary equipment is prudent to reduce time needed to restore critical services. (2) Implementation of near -term actions that insulate in -Delta native fish from being drawn into the state and federal pumps. The crisis of dwindling populations of Delta smelt illustrate the incompatibility of how water is conveyed. The SCWC supports those actions that would isolate smelt in the western Delta and create a physical and hydraulic barrier to the smelt being taken at the pumps while at the same time restoring ecosystem functions. (3) Elimination of long term conveyance system constraints so that State and Federal water supply facilities can reliably secure adequate high - quality Delta water supplies. The SCWC supports the inclusion of an isolated /peripheral conveyance system as a priority in a `vision'. We recognize that how such a structure would be designed and operated, and what institutional mechanisms would be necessary, are yet undefined, as are a plethora of other implementation issues.
