HomeMy WebLinkAboutROI NO 0468RESgL~UTION 0FINTENTION TO IMPROVE STREET DISTRICT NO. ~ IN THE CITY OF BAKERSFIELD, CALIFORNIA. SECTION 1. SECTION BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BAKERSFIELD, as follows: That it is the intention of the City Council of the City of Bakersfield, to order the following work to be done and improvement to be made in the said City, to-wit: That the curb grades at the intersection of East 19th Street and Miller Street as established by Ordinance No. ll2 New Series passed and adopted by the Council of the City of Bakers- field, January 9th, 1922, at 103.40 be changed and re-established at 102.?0; which figures represent the elevation of the top of the curbs in feet and hundredths of a foot above the datum plane as established by Ordinance No. 18, passed and adopted by the Board of Trustees of said City May 3rd, 1898, the existing grades and the proposed grades are fully set forth and shown on the plan and which said plan is now on file in the office of the 0ity Clerk and is hereby referred to for further and complete particulars. That cement concrete curbs and sidewalks be constructed to the official line and grade on either side of East 19th Street from a line 14 feet westerly from the easterly line of King Street to a line 14 feet ~asterly from the westerly line of Miller Street; except that on the southerly si~e of East 19th Street between Owens Street and East Truxtun Avenue no curb or sidewalk shall be constructed; -1- SECTION SECTION That cement concrete curbs and sidewalks be con§tructed to the official line and grade on either side of Fremont Street from the westerly line of Gage Street to a line 14 feet easterly from the westerly llne of Miller Street; That cement concrete curbs and sidewalks be constructed to the official line and grade on either side of Eureka Street from the westerly line of Owens Street to a line 14 feet easterly from the westerly line of Miller Street; Including all street intersections within the limit~ of the above descriptions and excluding therefrom the whole or any portion of stree~ or street intersections on which curbs or sideWalks have been constructed to the official line and and excepting also such portions as are required by law to be kept in order or repair by any person or company having railroad tracks thereon. All of said work and inprovement is to be done in accOrdan6e with the Plan and specifications heretofore and on the ~day of December, 1922, adopted by the Oouncil of the City of Bakersfield, said plan being e~t'itled "PLAN FOR THE IMPROVEMENT OF STREET DISTRICT NO. ~ IN-THE. CITY OF BAK~RSFIE~LD, CALIF.", and said specifications being entitled "SPECIFICATION8 FOR IMPROVEMENT OF STREET DISTRICT NO.%~ IN THE CITY OF BAKERSFIELD, CALIF,"., and which said plan and specifications ~e on file in the office of the City Clerk of the Gity of Bakersfield, and are hereby referred to and by such reference made a part and portion hereof, and in this connection the said plan and specifications also show the exact location of the aforesaid work and improvement. A~D ~tEREAS, said contemplated work and improvement in the opinion of the said City Council is of more than local or Ordi- nary public benefit, said ~ouncil hereby makes the expense of said work and improvement chargeable upon a district, which district said City a~uncil hereby declares to be the district benefited by said work and improvement and to be assessed to pay the costs and expenses thereof, and which said district is bounded and described as follows: Beginning at a point of intersection of a line 14 feet westerly from md parallel to the easterly line of King Street with a line 180 feet northerly from and parallel to the northerly line of East 19th Street and r~nning thence easterly on said line parallel to the northerly line of East 19th Street to a point 14 feet easterly from the westerly line of Miller Street; thence southerly on a line parallel to the westerly line of Miller Street to a point 150 feet southerly from the southerly line of Eureka Street; thence westerly on a line parallel to the southerly line of Eureka Street to a point 190 feet westerly from the westerly line of Owens Street; thence northerly on a line parallel to the westerly line of Qwens Street to'a point l§O feet northerly from the northerly line of ~E~u-eka Street; thence easterly on a line parallel to the northerly line of Eureka Street to a point 200 feet westerly from the westerly line of Gage Street; thence northerly ~ a line parallel to the westerly line of GGage Street to a point 150 feet southerly from the southerly line of East 19th Street; thence westerly on a line parallel to hhe southerly line of East 19th Street to a point 14 feet westerly from the east- e~ly line of King Street; thence northerly on a line 14 feet westerly from~and parallel to the easterly line of King Street to the point of beginning. · ll of the herein proposed work shall be done in pursuance of ~u act of the Legislature of the State of California, designated the "Improvement Act of 1911" approved April 7th, 1911, and all acts amendatory thereof. -3- Notice is hereby given that on Monday the /~ day of January,~ 192S, at 8 o'clock P.M. at the regular meeting of said City Council in the Council Chambers of said City Gouncil in the City Hall of the City of Bakersfield, any and all persons having any objections to the proposed work or improvement may appear before said City Council and show cause why said proposed improve- ment should not be carried out in accordance with said Resolution. Notice is further given that on Monday the ~ay of January, 1923, at 8 o'clock P.M. which is the time fixed for hearing objections to the proposed work and improvement, any and all persons having any objection to the proposed change of said grade may appear before said City Council and make objections to the proposed change of said grade, and failure to make such objec- tions at such time shall be deemed to be a waiver of all objec- tions to the proposed Change or modifications of grades and shall operate as a bar to any claim for damages or any subsequent action looking to the prevention of the work or the recovery of damages on account of the performance of the work to such changed grades. The City Clerk of said City of Bakersfield shall cause this Resolution of intention to be published twice in the The Daily Report, a daily newspaper printed, published and circulated in said City of Bakersfield, and hereby designated for that purpo~ by said City Council. The Street Superintendent of the ~ity of Bakersfield shall cause to be conspicuously posted along the lines of said contem. plated work and improvement and along all the open streets within said district notices of the passage of this Resolution of Inten- tion in the manner and form required by law. I HEREBY CERTIFY that the foregoing Resolution of Intention was duly and regularly introduced, passed and adopted b,y the City Council of the ~ity of Bakersfield, at a regular meet~ of said City Council held on the ./~day of December, 1923, by the follow- ing vote: -4- Ayes: Car~e, Gril~th, Hare, Hougham, Nelson, Robinson, Smith.
