The purpose of the permit Is to cover the discharge of storm water within the City and County Jurisdictions. The City and County have jurisdiction and /or maintenance responsibilities for the storm drainage system In the Bakersfield urbanized area. 80% of storm water discharges Into retention /detention basins (sumps), while the balance Is discharged Into the Kern River and local Irrigation canals. Many of these discharge points are considered to be waters of the United States and the State. As such, discharges of storm water are regulated under the authority of ifie Water Code and the Clean Wafer Act. The updated NPDES permit Is required under these authorities and expires in December 2018. Since the early 2000's, the Water Resources Department has overseen the NPDES storm water monitoring and reporting program. The Water Resources Department works with other City Departments and the County to prepare and submit Annual Reports on permit compliance to the Regional Water Quality Control Board (RWQCB), The Water Resources Department also samples storm water going to the Kern River during two rain events annually. Permit compliance Is a City inter- departmental effort, as well as a joint effort between the City and County. The permit requires that the City and County administer a Storm Water Management Plan (SWMP) to run a comprehensive stormwater program, Multiple City departments and the County recently worked together to develop a new S:UO14MEMOSM14_0_I8'JPiMPe tllpdeie.d= • B A K E R S F I E L D MEMORANDUM September 19, 2014 TO: Alan Tandy, City Manager All Department Heads FROM: Art Chianello, Water Resources Manager SUBJECT: City of Bakersfield and County of Kern Storm Water Discharges from Municipal Separate Storm Sewer System - National Pollutant Discharge Elimination System Permit Background: In December 2013, the City of Bakersfield (City) and the County of Kern (County) were Issued an update to theirjoint National Pollutant Discharge Elimination System (NPDES) permit. Program Effectiveness Assessment and Reporting The updated permit also required that a Copper /Zinc Investigation and Reduction Plan, and also a Monitoring Program /Data Assessment Methodology be submitted by September 8, 2014. These reports were also submitted to the RWQCB with the SWMP. The City has had recent discussion with the EPA and the EPA has Indicated that they will Increase Involvement with the City to ensure compliance with the permit. Regular phone conference meetings with the City, County, and EPA were held during the SWMP development period. If the City does not reach compliance, the EPA has stated that they have various options such asJudicial action, administrative actions, etc. They Indicate thatthey are extremely concerned with the City's (and County's) pattern of non - compllance on certain Issues. They have offered to participate In our efforts to gain compliance. They wish to participate In meetings, review draft documents, provide assistance if required. It should be noted that requirements of the new permit will add to the financial burden of running the storm water program for the City and County. There are enhanced requirements that will require additional staff time and funds. Many municipalities statewide that have recently received their updated permit have stressed to the State similar concerns.
