A RESOLUTION DISPENSING WITH BIDDING
PROCEDURES DUE TO NEED FOR URGENT
REPAIRS OF PARKING STRUCTURE AT THE
COMMUNITY DEVELOPMENT BUILDING, AND
AUTHORIZING ENGLE AND COMPANY
STRUCTURAL ENGINEERING TO PERFORM
DESIGN SERVICES AND AUTHORIZING
MONROE CONSTRUCTION, AND ANGELUS
WATERPROOFING AND RESTORATION TO
PERFORM NECESSARY REPAIRS, NOT TO
EXCEED $110,000
WHEREAS, on May 9, 2014, Public Works staff responded to a call
regarding the failure of a reinforced concrete beam in the parking structure
adjacent to the Community Development building; and
WHEREAS, the Public Works Director was informed that the repairs could
not be made by City staff alone; and
WHEREAS, a Structural Engineering firm, Engle and Company, was
consulted and determined the beam had failed but the structure was not in
imminent danger of collapse; and
WHEREAS, it was determined that vehicles should not park above or below
the failed beam area until a detailed structural analysis could be completed;
and
WHEREAS, to remedy this situation, the Public Works Director authorized
Engle and Company Structural Engineering to investigate the failure and
evaluate cost effective repairs; and
WHEREAS, on or about August 20, 2014, the Public Works Director received
a design plan from the structural engineering firm based on a detailed analysis
of the repair needed for the failed beam; and
WHEREAS, after reviewing the extent and nature of the structural repair
needed, the Public Works Director declared this condition to be of urgent
necessity requiring work, supplies, equipment and materials urgently necessary
for the preservation of life, health and property; and

WHEREAS, in addition, the Public Works Director authorized Monroe
Construction to replace the tension steel in the concrete beam with the use of
epoxied anchors and tension rod along with pressure epoxying the cracked
portions; and
WHEREAS, in addition, the Public Works Director authorized Angelus
Waterproofing and Restoration to reslope the roof deck and waterproof the
new material.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Bakersfield
as follows:
1. The above recitals are true and correct and are incorporated
herein by reference.
2. Based on the facts included in the above recitals, the work
performed by Engle and Company Structural Engineering, Monroe
Construction, and Angelus Waterproofing and Restoration was of
urgent necessity for the preservation of life, health or property,
thereby allowing the dispensing of bidding requirements as set forth
in Section 136 of the City Charter and Section 3.20.060 of the
Bakersfield Municipal Code.
3. The Finance Director is authorized to dispense with bidding in
accordance with Section 3.20.060 of the Bakersfield Municipal
Code.
4. The expenditure of funds to Engle and Company Structural
Engineering, Monroe Construction, and Angelus Waterproofing and
Restoration described herein for the work, supplies, equipment and
materials must not exceed $110,000 in aggregate.
