BE IT RESOLVED BY THE COUNCIL OF THE CITY OF BAKERSFIELD, as follows: That it is the intention of the City council of the City of Bakersfield, to order the following work to be done and improvement to be made in the said City, to-wit: SECTION 1. That California Avenue frmm the easterly line of Chester Avenue to the easterly llne of E Street be graded; that cement concrete gutters be constructed on either side of the roadway, and that the following described portions of said roadway be paved with a four (4) inch asphalt concrete base and a one and one-half (1½) inch Warrenite-Bitulithic wearing surface; (a) A strip 24 feet wide and 12 feet on either side of the Center line of said California Avenue from a line 33 feet easterly from smd parallel to the easterly line of Chester Avenue to the easterly line of N Street. (b) Those portions of the intersections of K and L Streets with California Avenue lying north of a line l~ feet northerly from and parallel to the center line of California Avenue. (c) Beginning at a point in the easterly line of Chester Avenue 19.4 feet northerly from the southerly line of California Avenue and running thence northerly along the easterly llne of Chester Avenue to a point 19.4 feet southerly from the northerly line of California Avenue; thence southeasterly on a straight line~ the point of intersection of a line l~ feet northerly from and parallel to the cente~ line of California Avenue with -1- a line 33 feet easterly from and parallel to the easterly line of Chester Avenue; thence southerly on a line parallel the easterly line of Chester Avenue 24 feet; thence south- westerly on a straight line to the point of beginning. to SECTION 2. That California Avenue from the easterly line of M Street to the westerly line of Q Street b~ graded; that cement concrete curbs aud gutters be constructed to the official line and grade on either side of said avenue and that a strip 24 feet wide and l~ feet on either side of the canter line of said avenue be paved with a four (4) inch asphalt concrete base and a one and one-half (l~) inch Warrenite- Bitulithic wearing surface; Including all intersections of streets and alleys within the limits of the above descriptions and e~luding therefrom the whole or any portions of streets, alleys, street intersec~tioDs or alley intersections on which curbs, gutters or pavements have been eonstructed to the official line and grade. SECTION 3. That a strip thirty-four (34) feet wide and 17 feet on either side of the following described llne in California Avenue be graded and that a strip twenty-four (24) f~et wide and 12 feet on either side of the same line be paved with a four (4) inch asphalt concrete base and a one aud one-half (l~) inch Warrenite-Bitulithic wearing sturface. Said line being described as ~ollows: Beginning at the intersection of the center line of California Avenue with the westerly line of Q Street and running thence easterly along the center line of California Avenue to a point 80 feet westerly from the easterly line of T Street; thence northeasterly on a straight line to a point in the center line of said California Avenue ~0 feet easterly from the easterly line -2. of T Street; thence easterly along the center line of said California Avenue to the westerly line of Union Avenue. SECTION 4. That cement concrete culverts covered with corrugated of iron be constructed as shown on the plans at the intersections K, N and V Streets with California Avenue. All of said work and improvement is to be done in accordance with the plane and specifications heretofore and on the ~ day of ~~/. , 1922~ adopted by the Council of the City of Bakersfield, said plar&Sbeing entitled "PLAN FOR THE I~PROVEMENT OF STREET DISTRICT N0.~/ IN TttE CITY OF BAKERSFIELD, CALIF."~ and said specifications being entitled "SPECIFICATIONS FOR THE I~PROVE~ENT OF STREET DISTRICT N0..Z~. ~/ IN THE CITY OF BAKERSFIELD, CALIF.", and which said plans and specifications are on file in the office of the City Clerk of the City of Bakersfield, and are hereby referred to and by such reference made a part and portion hereof. Attention is called to the ~arrenite-Bitulithlc License Mixture Agreement of Warren Brothers Company of Boston, ~ass., 31st, 1922, and on file in the office of the of date August City Clerk. AND. ~HEREAS, said contemplated work and improvement in the opinion of the said City Council is of more than local or ordinary public benefit, said Council hereby makes the costs and expenses of said work and improvement chargeable upon a district, which district said City Council hereby declares to be the district benefited by said work and improvement and to be assesse~ to pay the costs and espenses t~ereof, and which said district is bounded and described as follows: Beginning at a point in the easterly line of Chester Avenue 305.25 feet northerly from the northerly line of California Avenue and running thence easterly on a line 305.25 feet northerly from and parallel to the -3- northerly line of California Avenue to the westerly line of N Street; thence southerly along the westerly line of N Street to a p~int 115.8 feet northerly from the northerly line of California Avenue; thence easterly on a line 118.8 feet northerly from and parallel to the northerly line of California Avenue to the westerly line of Union Avenue; thence southerly along the westerly line of Union Avenue to a point 139 feet southerly from the southerly line of California Avenue; thence westerly on a line 132 feet southerly from and psrallel to the southerly line of California Avenue to the easterly line of T Street; thence northerly along the easterly line of T Street ~o~feet; thence westerly on line 118.8 feet southerly from and parallel to,he southerly line of Califou~ia Avenue to the easterly line of Chester Avenue; thence northerly along the easterly line of Chester Avenue to the point of beginning. All in the City of Bakersfield, California. Notice is hereby given that serial bonds to represent unpaid assessments, and bear interest at the rate of seven per cent per annum will be issued hereunder in the manner provided by the Improvement Bond Act of 1915, and all acts amendatory thereof, the last installment of which bonds shall mature nine years from the 2nd ~ay of July next succeeding nine months from their date. Exeept as hereinabove otherwise provided for the issuance of said serial bonds all of the herein proposed work shall be done in pursuance of au act of the Legislature of the State of California, designated the "Improvement Act of 1911" approved April 7th, 1911, and all acts amendatory thereof. Notice is hereby given that on Monday the day of ~ , 1922, at 8 o'Clock P.M. at a regular meeting of the said City Council in the Council Chamber of said City Council in the City Hall of the City of Bakersfield, any and -4. all persons having any objections to the proposed work or improvement may appear before said City Council and show cause why said proposed improvement should not be carried out in accordance ~th said Resolution. The City Clerk of said City of Bakersfield shall cause this Resolution of Intention to be published twice in the DAILY RE?0RT, a daily newspaper printed, published and circulated in said City of Bakersfield, and hereby designated for that purpose by said City Council. The Street Superintendent of said City of Bakersfield shall cause to be conspicuously posted along the lines of said contemplated work and improvement and along all the open streets within said district, notice of the passage of this Resolution of Intention in the manner and form required by law, and in said notice he shall call attention to the Warrenite-Bitulithic License Nixture Agreement of the Warren Brothers Company of Boston, Nass., of date~ ~/, 1922, on file in the office of the City Clerk. I HEREBY CERTIFY that the foregoing Resolution of In- tention was regularly, introduced, passed and a(~opted by the Council of the City of Bakersfield, at a regular meeting of said Council held on the ~w~ day of the following vote: -' ~son, Robh~son, S~ith.
