HomeMy WebLinkAboutROI NO 0460-1- as follows: RESOLUTION OF INTENTION TO I~PROVE STREET DISTRICT NO. B1, IN THE CITY OF BAKERSFIELD, CALIFORNIA. BE IT RESOLVED BY THE COUECIL OF. THE CITY OF BAKERSFIELD, That it is' the intention of the City Council of the City of Bakersfield, to order the following work to be done and improvement to be made in said City to-wit: That a strip 24 feet wide and 1R feet on either side of the following described line of Oak Street be gra~ed and that a strip 18 feet wide and 9 feet on air, her side of said line be paved with a four (4) inch asphalt concrete base and a one and one-half (l~) inch Warrenite-Bitulithic wearing surface, said line is described as follows: beginning at the intersection of the center line of Oak Street with the extension westerly of the center line of 24th Street ~nd runn~ing thence S-O0°-02t-30"-E along the center line of Oak Street to the beginning of a curve at a point 71.86 feet distant northerly, along said center line, from the extension westerly of the northerly Iine of California Avenue; thence to the right along said curve whose radius is 200 feet a distance of ~6.78 feet; thence S-~°'~-80"-W a distance of 1~8~11 feet. to the beginning of a curve whos~e radius is 200 feet; thence to the left along said curve a distance.20.88 feet; thence S-O0°-OI-~-$O"-W along the center line of said Oak Street to ~ts intersection with the center line of .Chester Lane; thence S-O0°-O0~-30"-M along the center line of said Oak Street to the beginning of~ a curve at a point 88 feet northerly', along said center line, from the extension westerly of the northerly line of Palm Street; thence to the right along said curve whose radius is 200 feet~ a distance of 29.~8 feet; thence S-8°-G2~-~0"-~ to an intersection with the the southerly line of said Palm Street, thereof as are required by law to be paved~ extension westerly of (excepting such portions kept in order or repair by any person or company having railroad or car tracks thereon.) Said Street is wholly within the corporate limits of the City of Bakers- field,.(the westerly line of said Street being the westerly City Limits of said City, as shown upon the map entitled "LAP OF THE CITY OF B~tKERS- FIELD," filed for record in the office of the County Recorder of Kern County November 25, 1898. All of said work and improvement is to be done in accord- ance with the plan~ and specifications heretofore and on the //4 day of September, 19B~, adopted by the Council of the City of Bakersfield, said plan~ being entitled "PLAN FOR THE I~P~OVE~ENT OF STREET DISTRICT NO. 81, IN THE CITY OF BAKERSFIELD, CALIF?!, and said specifications being entitled "SPECIFICATIONS FOR THE I~PROVE~I~T OF STREET DISTRICT NO. 81, IN THE CITY OF BAE~RSFIEL~ CALIF.", and which said plan~ and specifications are on file in the office of the City Clerk of t~e City of Bakersfield, and are hereby referred to and by such reference made a part an~ portion hereof, and in this connection the said plans and specifications also show the' exact location of the aforesaid work and improvement. Attention is called to the Warrenite-Bitulithic License Nixture Agreement of ~arren Brothers Company of Bomton Nass., of date ~ ~-~--~z~, l~, and on file in the office of the City Clerk. AND ~HEREAS, said contemplated work and improvement in the opinion of said City Council is of more than local or ordinary public benefit, said Council hereby makes the costs and expenses of said work and improvement chargeable as follows: That the sum of fifteen thousand ($18,00~00) dollars be paid out of the treasury of the ~ity of Bakersfield from the general fund for the purpose of defraying part of the costs and expenses of the hereinabove mentioned improvement, provided however, that the above-mentioned sum shall not be paid until after the contractor has fulfilled his contract to the satisfaction of the Street Superintendent of the C~ty of Bakersfiel~$ And that the balance of the costs and expenses of said improvement be assessed upon a district, which district said City Council hereby declares to be the district benefited by said work and improvement and which said district is bounded and described as follows: Beginnin~ at a point in the center line of ~4th Street l~ feet easterly from the easterly line of Oak Street and running thence southerly on a line 13~ feet easterly from and parallel to the easterly line of Oak Street to the southerly line of California Avenue; thence westerly along said southerly line of California Avenue a distance of 38.68 feet; thence southerly on a line 13~ feet easterly from and parallel to the easterly line of Oak Street to the southerly line of Palm Street; thence westerly along the southerly line of Palm Street and its extension westerly a distance of 3~4 feet; thence northerly on a straight line to a point in the'center line of Chester Lane 13~ feet westerly from the westerly line of Oak Street; thence northerly on a line 13~ feet westerly from and parallel to the westerly line of Oak Street to its intersection with the extension westerly of the southerly line of California Avenue; thence easterly along said extension a distance of 18.08 feet; thence northerly on a line 13~ feet westerly from and parallel to the westerly line of Oak Street to £~s intersection with the extension westerly of the center line of ~th Street; thence easterly along said extension and along the center line of B~th Street to the point of beginning. All of the herein proposed work shall be done in pur- suance of an act of the Legislature of the State of California, designated, "An act to provide for work upon streets, avenues, lanes, alleys, courts, and places forming the exterior boundaries of any municipality whether partly, or wholly, within or without said bound- aries ~nd providing for the construction of sewers, drains and side- -3- walks thereon and in connection tb. erewith," approved April 21, 1911, and all acts amendatory thereof. The City Clerk of Bakersfiel~ shall cause this Re~olution Of Intention to be published twice in THE DAILY REPORT, a daily news- paper printed, published and circulated in said City of Bakersfield, and hereby designated for that purpose by said Council, and he shall also cause to be conspicuously posted on or near the chamber door of the Council Chambers of the Council of the City of Bakersfield a copy of said Resolution of IntentiOn for two days in the manner and form required by law. The Street Superintendent of said City of Bakersfield shall cause to be conspicuously posted along the line of said contemplated work and improvement and along all the open streets within said district a notice headed "NOTICE OF STREET '~OEK", and he shall also cause to be published in THE DAILY REPORT, a daily newspaper printed, published and circulated in said City of Bakersfield, and hereby designated for that purpose by said Co~ncil a copy of said Notice of Street ~Vork, for six days in the manner aud form required by law. I HEREBY CERTIFY that the foregoing Resolution of Intention was regularly introduced, passed and adopted by the Council of the City of Bakersfield, at a regular meeting o~ said Council on the _ ~/~ day of September, 1922, by the following vote: Ayes: Carlisle.
