A RESOLUTION DETERMINING THAT A PETERSON PORTABLE
ELECTRIC RECYCLER, CANNOT BE REASONABLY OBTAINED
THROUGH THE USUAL BIDDING PROCEDURES AND
AUTHORIZING THE FINANCE DIRECTOR TO DISPENSE WITH
BIDDING THEREFOR AND PURCHASE A PETERSON MODEL
6750D FROM THE MANUFACTURER, PETERSON
CORPORATION, NOT TO EXCEED $1,058,000.
WHEREAS, the City of Bakersfield needs to replace an existing Morbark grinder
at the Mount Vernon Recycling and Composting Facility; and
WHEREAS, the Solid Waste Division has rented and /or demonstrated all
available models of grinders to determine the best unit for operations at the Mount
Vernon Recycling and Composting Facility. The Peterson Corporation model is safer
and more productive than all other models; and
WHEREAS, a Peterson portable electric recycler can only be acquired
through the manufacturer, Peterson Corporation; and
WHEREAS, the Public Works Director recommends the Council find that said
Peterson Model 6750D portable electric recycler can only be reasonably
obtained from Peterson Corporation and has recommended that the Council
authorize dispensing with bidding requirements in accordance with subsection
D.2 of Section 3.20.060 of the Bakersfield Municipal Code.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as
follows:
1. The above recitals are true and correct and incorporated herein by
reference.
2. The Council hereby finds that the purchase of a Peterson Model 6750D
portable electric recycler can only be reasonably obtained from the manufacturer,
Peterson Corporation for the reasons set forth above.
3. The Finance Director is authorized to dispense with bidding therefor in
accordance with Subsection D.2 of Section 3.20.060 of the Bakersfield Municipal
Code and to negotiate the purchase of same, not to exceed $1,058,000.
