HomeMy WebLinkAboutROI NO 0456RESOLUTION OF INTENTION NO. ~ RESDLUTION OF INTENTION.TO IMPROVE STREET DISTRICT NO. 4gi'~ IN THE CITY OF BAKERSFIEL~ORNIA, AND TO ISSIIE BONDS IN PAYMENT THEREFOR. BE IT RESOLVED BY THE COUNCIL OFTHE CITY OF BAKERSFIELD, as follows: That it is the intention of the City Council of the City of Bakersfield, to order the following work to be done and improvement to be made in said City, to-wit: That Kern Street from the northerly line of Jackson Street to the southerly line of Lake Street be graded; that cement concrete curbs and gutters be constructed to the official line and grade on either side of said street and that the roadway be paved with a three and one-half (3~) inch asphalt concrete base and a one and one half (l~) inch Warrenite-Bitulithic wearing surfaces Including all intersections of streets and alleys with- in the limits of the above description and excluding therefrom the whole or any portion of the street, ~street intersections or alley ~ntersections on which curbs gutters or pavement have been const~acted to the official line and grade; All of said work and improvement is to be done in accordance with the plans and specifications heretofore and on of ~, 19~, adopted by the Council of the the City of Bakersfield, said plans being entitled "PLAN FOR THE IMPRO~ENENT OF STREET DISTRICT NO..~.~ IN THE CITY OF BAKERSFIELD, CALIF.", and said specifications being entitled, "SPECIFICATIONS FOR THE IMPROVEMENT OF STREET DISTRICT NO. ~ IN THE CITY OF BAKERSFIELD, CALIF.", and which said plans and specifications are on file in the office of the City Clerk of the City of Bakersfield, and are hereby referred to and by such reference made a part and portion hereof. -1- Attention is called to the Warrentte-Bttulithic License Mixture Agreement 'of Warren Brothers Company of Boston, of date ~ J~ , 1922, and on file in the office Mass., of the City Clerk. And Whereas, said contemplated work and improvement in the opinion of the said City Council is of more than local or ordinary public benefit, said Council hereby makes the costs and expenses of said work and improvement chargeable upon a district, which district said City Council hereby declares to be the dis- trict benefitted by said work and improvement and to be assessed to pay the costs and expenses thereof, and which said district i~ bounded and described as follows: Beginning at a point in the northerly line of Jackson Street 200 feet easterly from the east- e~ly line of Kern Street and running thence northerly on a line 200 feet easterly from and parallel to the easterly line of Kern Street to the southerly line of Lake Street; thence westerly along the southerly line of Lake Street to a point 200 feet westerly from the westerly line of Kern Street; thence southerly on a line 200 feet westerly from and parallel to the westerly line of Kern Street to the northerly line of Jackson Street; thence easterly along the northerly line of Jack~n Street to th~ point of beginning. All in the City of Bakersfield, California. Notice is hereby given that serial bonds to represent unpaid assessments, and bear interest at the rate of seven (7%) per Cent per annum will be issued hereunder in the m~uner pro- vided by the Improvement Bond Act of 1915, and all acts ~nenda- tory thereof, the last installment of which bonds shall mature ~ne years from the 2nd day of July next succeeding nine months from their date. -2- I F~xcept as hereinabove otherwise provided for the issuance of said serial bonds, all of the herein proposed work shall be done in pursuance of an act of the Legislature of the State of Califor- nia, designated the "Improvement Act of 1911" approved April ~th, 1911, and all acts amendatory thereof. Notice is hereby given that on Monday the'~ ~ day of ~, 19~2, at 8 P.M. a regular otclook at meeting the said city Council in the Council Chamber of said City Council in the City Hall of the City of Bakersfield, any and all persons having any objections to the proposed work or improvement may appear be- fore said City Council and show cause why said proposed improve- ment should not be carried out in accordance with said Resolution. The City Clerk of said City of Bakersfield shall cause this Resolution of Intention to be published twice in the THE DAILY REPORT, a daily newspaper printed, published and circulated in said City of Bakersfield, and hereby designated for that purpose by said City Council. The Street Superintendent of said City of Bakersfield shall cause to be conspicuously posted along the line of said con- templated work and improvement and along all the open streets with- in said district, notice of the passage of this Resolution of In- tention in the manner and form required by law, and in slid notice he shall call attention to the Warrenite-Bitulithlc License Mixture Agreement of the Warren Brothers Company of Boston, Mass., of date ~ /f , 1922, on file in the office of the City Clerk. I HEREBY CERTIFY that the foregoing Resolution of Inten- tion was regularly introduced, passed and adopted by the Counciloof the City of Bakersfield, at a regular meeting of said Council held on the%/~day of ~ 1922, by the following vote: Ayes: ~di~e, G~, Hare, Hou~am, Nelson, R~son, ~mi~.
