A RESOLUTION DISPENSING WITH BIDDING
PROCEDURES DUE TO EMERGENCY REPAIRS
OF ROADWAY ON TRUXTUN AVE FROM 1,000
FEET WEST OF THE RAILROAD UNDERPASS
TO EMPIRE DRIVE
RECITALS
VOtEREAS, on Wednesday, March 13, 2002, City crews were preparing Truxtun
Avenue from 1,000 feet west of the railroad underpass to Empire Drive for resurfacing. They
discovered a structural section of the roadway with 2 inches of asphalt over sand which is
unacceptable; and
VOtEREAS, the Public Works Director was informed that this structural section would
not hold up to the volume of traffic on Truxtun Avenue, and
WHEREAS, the Public Works Director instructed City crews to remove 8 inches of
material and replace it with full depth asphalt; and
WHEREAS, on the same day, the Public Works Director was informed that the repairs
could not be fixed by City staff alone in a timely manner; and
WHEREAS, the Public Works Director declared this problem an emergency and the
work to be performed was of urgent necessity for the preservation of life, health, or property; and
WHEREAS, the Public Works Director determined that one west bound lane at this site
had to be closed to repair the problem. Repairs were completed by Thursday, March 14, 2002,
and the street reopened; and
WHEREAS, due to the nature of repairs, the potential liability to the City, and the
potential safety hazard to the public, outside forces were required to repair the problem quickly;
and
WHEREAS, to remedy this emergency, the Public Works Director authorized
construction services on a time-and-materials basis to repair the problem.
NOW, THEREFORE, BE IT RESOLVED, by the Council of the City of Bakersfield
as follows:
1. The above recitals are true and correct and incorporated herein by reference.

City Council hereby determines that based on the above recitals the work
performed was of urgent necessity for the preservation of life, health or property,
thereby, allowing the dispensing of bidding requirements as set forth in Section
136 of the City Charter and Section 3.20.060 of the Bakersfield Municipal Code.
I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the City
Council of the City of Bakersfield at a regular meeting thereof held on
MAR 20 Z00Z , by the following vote:
