Exempt pursuant to Code 27383 DOCUMENT ELECTRONICALLY RECORDED IN THE OFFICIAL RECORDS The undersigned Grantor(s) declare(s) that the DOCUMENTARY TRANSFER TAX IS: $ 0 Grantee is Exempt Gov't Agency(R &T 11922) RESOLUTION NO. 027 -15 A RESOLUTION OF THE COUNCIL ORDERING THE VACATION OF THE SOUTH 11.25' OF 38TH STREET AND THE WEST 11.25' OF "L" STREET (WARD 2) o��PKF9� -n > m v o 081GINA� RESOLUTION NO. 0 27' 19, A RESOLUTION OF THE COUNCIL ORDERING THE VACATION OF THE SOUTH 11.25' OF 38TH STREET AND THE WEST 11.25' OF "L" STREET (WARD 2) WHEREAS, on WEDNESDAY, February 11, 2015, the Council of the City of Bakersfield, pursuant to the provisions of the "Public Streets, Highways and Service Easements Vacation Law," Government Code Sections 8300 et seq. of the Streets and Highways Code of the State of California, passed and adopted Resolution of Intention No. 1825 declaring its intention to order the vacation of the south 11.25' of 38th Street and the west 11.25' of "L" Street, adjacent to 3731 L Street; and WHEREAS, the Council did fix a time and place for hearing all persons interested in or objecting to said proposed vacation, which hearing was held on March 4, 2015, after notices of said hearing were duly published and posted as required by law; and WHEREAS, for the above - described project, it was determined that the proposed vacation is exempt from CEQA, pursuant to Section 15061 (b) (3) of CEQA Guidelines (General Rule) in that there is no possibility that the proposed action could have a significant effect on the environment; and WHEREAS, on December 17, 2014, the Planning Department found the vacation to be consistent with the Metropolitan General Plan, per local ordinance. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as follows: 1. The above recitals are true and correct and are incorporated herein. 2. This Resolution is adopted pursuant to Section 8300, et seq. of the Streets and Highways Code of the State of California. 3. The City is to reserve a Public Utility Easement (PUE) over the vacated areas of 38th Street and L Street. 4. The Council orders the vacation of the south 11.25' of 38th Street and the west 11.25' of "L" Street, (more specifically described Exhibit "A" and illustrated in Exhibit "B ", which is attached hereto and incorporated herein), all in the City of Bakersfield, County of Kern, State of California. 5.
