Minutes of a regular meeting o£ the Council of the City
of Bakersfield, California, held in the Council Chambers of City
Hall at 8:00 P.M., April 19, 1976.
The meeting was called to order by Mayor Hart followed
by the Pledge of Allegiance and Invocation by Reverend Victor
Mitchell, Retired Chaplain.
The City Clerk called the roll as follows:

Adoption of Ordinance No. 2272 New
Series of the Council of the City
of Bakersfield adding Sections
17.08.152 and 17.08.432 to Title 17
of the Municipal Code relating to
definitions of Day Nursery and
Nursery School.
Upon a motion by Councilman Medders, Ordinance No. 2272
New Series of the Council of the City of Bakersfield adding
Sections 17.07.152 and 17.08.432 to Title 17 of the Municipal Code
relating to definitions of Day Nursery and Nursery School, was
adopted by the following roll call vote:

Approval of Agreement between City
and Pacific Gas & Electric Company
to install street lights in Under-
ground Utility District No. 4.
Upon a motion by Councilman Bleecker, Agreement between
the City and Pacific Gas & Electric Company for installation of
street lights in Underground Utility District No. 4, was approved
and the Mayor was authorized to execute same.
First reading of an Ordinance of
the Council of the City of Bakers-
field changing the name of a portion
of Bonaire Street to Ironwood Way.
After discussion, first reading was considered given an
Ordinance of the Council of the City of Bakersfield changing the
name of a portion of Bonaire Street to Ironwood Way.

Adoption of Resolution No. 25-76 of
the Council of the City of Bakers-
field supporting the State
Reclamation Board's designated Flood-
way Program in principle, determining
to provide assistance to the Reclama-
tion Board to carry out their
objectives in the City of Bakersfield
and requesting execution of Coopera-
tive Agreement.
The Board of Reclamation is in
a floodway on the Kern River and request
this program. Designation of the floodway is consistent with the
City's interest because it would minimize potential flooding
during the 100-year storm, is in keeping with National Flood
Insurance Program, and will assist in the application of Flood
Plain Zoning upon completion of Kern River No. 4 and No. 5 annexa-
tions. The City may through joint powers agreement exercise the
State Reclamation Board's authority for that portion of the
Floodway within the City's jurisdiction.
Mr. Paul Flannigan, Civil Engineer for Department of
Water Resources and Staff Engineer for the Reclamation Board,
explained the designated floodway which extends from Golden State
Highway downstream to approximately one mile north of Tupman and
also extends to Buena Vista Lake, a distance of approximately 33
miles. Mr. F~annigan stated that main purpose of a designated
floodway is to provide an area for the 100-year flood and control
the type of development that may impede the free £1ow of water or
force it somewhere else and increase the velocity.
After a lengthy discussion, upon a motion by Councilman
Rogers, Resolution No. 25-76 of the Council of the City of Bakers-
field supporting the State Reclamation Board's designated Floodway
Program in principle, determining to provide assistance to the
Reclamation Board to carry out their objectives in the City o£
Bakersfield and requesting execution of Cooperative Agreement,
with the amendment of Section 2 changing the wording from flood
plain to floodway, was adopted by the following roll call vote:

Approval of Construction Change Order
No. 2 to Contract No. 75-112 with
Fred S. Macomber for work on West
Wing of City Hall.
This Change Order will provide additional face brick to
match those presently being used for future addition and adjusts
the contract price for several minor additions to contract work.
Change Order No. 2 results in an increase of $2,822.00 in the
contract price. No additional time is allowed for completion as
a result of this Change Order. Sufficient funds are available
from budget savings.
Upon a motion by Councilman Bleecker, Construction
Change Order No. 2 to Contract No. 75-112 with Fred S. Macomber
for work on West Wing of City Hall, was approved and the Mayor
was authorized to execute same.
Approval of Annexation Boundaries
designated as Bernard No. 2.
Upon a motion by Councilman Rogers, Annexation Boundaries
designated as Bernard No. 2, located near the northwest corner of
the intersection of Edwards Avenue and Sandy Lane, portion of
Tentative Tract 3826 and covers Parcel Map 3548, presently being
processed, and containing .92 acres of uninhabited territory, were
approved and referred to the City Engineer and City Attorney for
referral to LAFC.
Approval of Annexation Boundaries
designated as Stockdale No. 9.
Upon a motion by Councilman Medders, Annexation Boundaries
designated as Stockdale No. 9, located on the north side of Stock-
dale Highway and west of Park Stockdale, and containing 8.45 acres
of uninhabited territory, were approved and referred to the City
Engineer and City Attorney for referral to LAFC.

Council, upon a motion by Councilman Christensen, the meeting was
