'~ 0 5 '~ AN ORDINANCE AMENDING SECTION 3.20.105 OFTHEBAKERSFIELDMUNIClPAL CODE RELATING TO CONTRACT PROCEDURES WHEREAS, Section 3.20.105C of the Bakersfield Municipal Code requires all contracts under which the City of Bakersfield is obligated to pay more than twenty-five thousand dollars to be authorized by the City Council; and WHEREAS, Section 3.20.105C requires City Council authorization whether or not such obligation will be paid or reimbursed by a third party; and WHEREAS, the City currently has a program under which it loans federal funds to property owners to rehabilitate single-family residences; and WHEREAS, City Council has reviewed and authorized such residential rehabilitation loan program, as well as set the maximum amount of money which can be loaned under that program; and WHEREAS, the Department of Housing and Urban Development has established loan underwriting guidelines which the city must follow; and WHEREAS, all loan documents are standard and all loans are secured by deed of trust on the property which is to be rehabilitated; and WHEREAS, the City Council elects not to review each individual loan contract, regardless of the dollar amount, as long as the loan amount does not exceed the City Council-adopted maximum. BE IT ORDAINED by the Council of the City of Bakersfield as follows: SECTION 1. Section 3.20.105C is hereby amended to read as follows: C. Amounts Over Twenty-Five Thousand Dollars. With the exception of contracts under the city's single-family residential rehabilitation program which are funded with federal funds, which do not exceed the City Council-adopted maximum amounts, all contracts under which the city is obligated to pay more than twenty-five thousand dollars, whether or not such amounts will be paid or reimbursed by a third party, shall be authorized only by the city council. Such contracts shall also require the signatures set forth in subsection B of this section. Page 1 of 3 SECTION 2.
