HomeMy WebLinkAboutORD NO 3637ORDINANCE NO. 8 B B 7 AN ORDINANCE AMENDING TITLE SEVENTEEN OF THE BAKERSFIELD MUNICIPAL CODE AND ZONING MAP NOS. 102-25 and 103-30 BY CHANGING THE ZONING OF 405 ACRES GENERALLY LOCATED IN THE DOWNTOWN CENTRAL BUSINESS DISTRICT FROM R.4 (MULTIPLE FAMILY RESIDENTIAL), C-O (PROFESSIONAL AND ADMINISTRATIVE OFFICE), C-1 (NEIGHBORHOOD COMMERCIAL), C-2 (REGIONAL COMMERCIAL) AND M-1 (LIGHT MANUFACTURING) TO C-C (COMMERCIAL CENTER); AND FROM (REGIONAL COMMERCIAL) AND C-C (COMMERCIAL CENTER) TO C-B (CENTRAL BUSINESS); ZONE CHANGE NO. 5607. WHEREAS, in accordance with the procedure set forth in the provisions of Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission held a public hearing on a petition (Zone Change No. 5607) to change the land use zoning of those certain properties in the City of Bakersfield generally located in the downtown central business district bounded by State Highway 178 on the north, "V" Street on the east, California Avenue on the south and "F' Street on the west; and WHEREAS, by Resolution No. 12-95 on February 2, 1995, the Planning Commission recommended approval and adoption of an ordinance amending Title 17 of the Municipal Code to approve the proposed rezoning as delineated on attached Zoning Map No. Nos. 102-25 and 103-30 marked Exhibit "A", by this Council and this Council has fully considered the recommendations made by the Planning Commission as set forth in that Resolution; and WHEREAS, the Planning Commission, in accordance with CEQA determined that the Negative Declaration adopted for GPA 4-94, Segment V was adequate as the proposal did not require substantial revision and no new information of substantial importance had not become available; therefore, the project would not have a significant effect on the environment, and the Council has considered said findings and all appear to be true and correct; and WHEREAS, the law and regulations relating to the preparation and adoption of Negative Declarations, as set forth in CEQA and City of Bakersfield's CEQA Implementation Procedures, have been duly followed by city staff, Planning Commission and this Council; and WHEREAS, the City Council, through the City Clerk, did set Wednesday, March 22, 1995 at the hour of 7 p.m. in the Council Chambers of City Hall, 1501 Truxtun Avenue, Bakersfield, California, as the time and place for a public hearing before said Council on said proposal, and notice of the public hearing was given in the manner provided in Title 17 of the Bakersfield Municipal Code where the number of property owners to whom notice would be mailed exceeds 1,000, and individual nc~f~ was given to property owners with property zoned M-l; and O~!~INAL WHEREAS, the City Council has considered and hereby makes the following findings: 1. All required notices have been given. 2. The provisions of the California Environmental Quality Act (CEQA) have been followed. The downtown area rezoning will not by itself have a significant effect on the environment. The impacts of future development projects within the boundaries of the rezoning area will be addressed through the environmental review and site plan review process for specific projects. 3. The proposed rezoning will strengthen and clarify overall development goals and policies for the downtown area, and will thereby encourage enhanced development opportunities for the downtown core area of Bakersfield. 4. The public necessity, general welfare and good planning practice justify the proposed rezoning consistent with the Metropolitan Bakersfield 2010 General Plan. SECTION 1. NOW, THEREFORE, BE IT ORDAINED by the Council of the City of Bakersfield as follows: All of the foregoing recitals are hereby found to be true and correct. 2. Section 17.06.020 (Zoning Map) of the Municipal Code of the City of Bakersfield be and the same is hereby amended by changing the land use zoning of that certain property in said City, the boundaries of which property is shown on Zoning Map Nos. 102-25 and 103-30 marked Exhibit "A" attached hereto and made a part hereof. SECTION 2. This ordinance shall be posted in accordance with provisions of the Bakersfield Municipal Code and shall become effective thirty (30) days from and after the date of its passage. ......... 000 .........
