A RESOLUTION OF THE COUNCIL OF THE CITY OF
BAKERSFIELD DIRECTING THE PUBLIC WORKS
DIRECTOR TO CONSTRUCT STANDARD CURB AND
GUTTER AND STANDARD DRIVE APPROACHES AT 2908
& 2916 McCALL AVENUE, CONFIRMING ASSESSMENT
AND AUTHORIZING TH E COLLECTION OF ASSESSMENTS
BY THE KERN COUNTY TAX COLLECTOR.
WHEREAS, at the request of the property owner the City is proposing to construct
standard curb & gutter, and standard drive approaches at 2908 & 2916 McCall Avenue;
and
WHEREAS, the City finds that to pay the construction cost of the curb & gutter, and
drive approaches in one payment would produce an economic hardship on the property
owner; and
WHEREAS, to assist the property owner in this area in paying the curb & gutter, and
drive approach construction cost the City has agreed to spread the cost of the fee over a
three-year period; and
WHEREAS, the property owner of the property (set forth in Exhibit "A") has entered
into an agreement with the City to pay the curb & gutter, and drive approach construction
cost through their property taxes over the next three-years.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield
as follows:
1. The foregoing recitals are true and correct and are incorporated herein.
2. The City Council hereby confirms and approves the individual assessment for
the curb & gutter, and drive approach construction cost set forth in Exhibit "A". Said
construction cost (assessment) shall be considered a lien on the owner's property also
shown on Exhibit "A".
3. The Kern County Tax Collector is hereby authorized to collect the assessment
for curb & gutter, and drive approach construction cost to be collected in three equal
payments over the next three fiscal years.
4. The provisions of Proposition 218 do not apply as the curb & gutter, and drive
approach construction cost was imposed as a condition of property development and at
the written request of the property owner.
