RESOLUTION AMENDiNG BOUNTDARY AND
APPROVING BOUNDARY MAP AS REVISED
CITY OF BAKERSFIELD
ASSESSMENT DISTRICT NO. 01-3
(MADISON GROVE/SAN LAUREN/MOUNTAIN VISTA/WESTLAKE)
WHEREAS, attached to this resolution as Exhibit A and by this reference
incorporated herein is a location map of proposed boundaries (the "Boundary Map"), said
location map entitled "Exhibit A - Location Map of Proposed Boundaries of City of Bakersfield
Assessment District No. 01-3 (Madison Grove/San Lauren/Mountain Vista/Westlake), County of
Kern, State of California", which map shows the separate areas to be assessed in this proposed
assessment district (the "Assessment District"); and
WHEREAS, said Boundary Map constitutes a revision of an earlier version
thereof (the "Prior Map") which was previously approved by Resolution No. 044-02, adopted by
this Council on March 20, 2002; and
WHEREAS, results of a preliminary appraisal of the fair market value of the
property proposed to be included within the Assessment District, as established by the Prior Map,
have established that a portion of said property has been determined not to have adequate value
to support its proportionate share of the cost of the proposed public improvements of the
Assessment District, as measured by the policy of this Council that such property must
demonstrate not less than a 3-1 value-to-lien ratio to be included within the Assessment District;
and

WHEREAS, in consultation with the affected property owner, it has been
determined to delete those portions of the property which do not meet the minimum value-to-lien
policy, and the Boundary Map shows the revised boundary for the Assessment District which
excludes such property;
NOW, THEREFORE, THE CITY COUNCIL HEREBY F1NDS, DETERMINES
AND RESOLVES as follows:
1. This Council approves the Boundary Map and adopts the revised
boundaries shown on the Boundary Map as describing the extent of the territory included in a
proposed assessment district to be known as the "City of Bakersfield Assessment District No. 01-
3 (Madison Grove/San Lauren/Mountain Vista/Westlake), County of Kern, State of California."
2. At such time as the formal boundary map, with boundaries conforming to
the Boundary Map and containing the matters and being in the form prescribed by Section 3110
of the California Streets and Highways Code, has been prepared and filed with the City Clerk, the
City Clerk is authorized and directed, without further consideration by this Council, to file a copy
of thereof with the Kern County Recorder for placement in the Book of Maps of Assessment and
Community Facilities Districts. In the meantime, all references to and descriptions of the
proposed boundaries of the Assessment District shall be by reference to the Boundary Map as set
forth in Exhibit A.
3. Resolution No. 044-02 is hereby rescinded, and the provisions thereof
directing the City Clerk to provide for recording of the Prior Map are correspondingly rescinded.

I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by
the Council of the City of Bakersfield at a regular meeting thereof held on May 22, 2002, by
