ORDINANCE NO.
AN ORDINANCE AMENDING SECTION 16.28.130 OF THE
BAKERSFIELD MUNICIPAL CODE RELATING TO
APPROVAL OF STREET NAMES IN CONJUNCTION
WITH TENTATIVE MAPS.
WHEREAS, the City of Bakersfield, filed an application requesting
amendment to Section 16.28.130 of Title 16 of the Municipal Code relating to approving
street names in conjunction with tentative tracts; and
WHEREAS, by Resolution No. 7-95 on January 19, 1995, the Planning
Commission recommended approval and adoption of said amendment and this Council
has fully considered the recommendation made by the Planning Commission as set forth
in that Resolution: and
WHEREAS, it was determined that the proposed ordinance amendment is
not a project in accordance with CEQA; and
WHEREAS, the law and regulations relating to CEQA and City of
Bakersfield's CEQA Implementation Procedures, have been duly followed by city staff,
Planning Commission and this Council; and
WHEREAS, the City Council has considered and hereby makes the
following findings:
1. All required public notices have been given.
2. The proposal is not a project as defined in CEQA.
3. The proposed amendment will provide more efficiency with regard
to approving street names on tentative tracts.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of
Bakersfield as follows:
SECTION 1.
All of the foregoing recitals are hereby found to be true and
correct.
2. Section 16.28.130 of the Bakersfield Municipal Code is hereby
amended to read as follows:
16.28.130 Street nalnes.
Each street or way which is to be dedicated, which is a continuation
of, or approximately the continuation of, any existing dedicated street or
way shall be shown on the tentative map and shall be given the same name
as such existing street or way. The proposed name of each other street or
way shall be shown on the tentative map and submitted to the Planning
Director for approval, and if such name is not a duplication of, or so
nearly the same as to cause confusion with, the name of any existing street
or way located in the city, or in close proximity thereto, and if such name
is appropriate for a street name, such name shall be approved. When any
such street or way forms a portion of any proposed street or way ordered
by the city council to be surveyed, opened, widened or improved, and in
such order a name therefor is assigned or designated, the name of such
street or way shown on the map shall be the same as the name contained
in said order.
SECTION 2.
This ordinance shall be posted in accordance with provisions of the
Bakersfield Municipal Code and shall become effective thirty (30) days from and after
the date of its passage.
