RESOLUTION ADOPTING THE CERTIFICATION OF THE
COMPLETION OF THE TIER 1 ENVIRONMENTAL IMPACT
REPORT (EIR-Tier 1) PREPARED BY THE STATE OF
CALIFORNIA DEPARTMENT OF TRANSPORTATION FOR
THE PROPOSED ALIGNMENT OF STATE ROUTE 58 FROM
STATE ROUTE 99 TO INTERSTATE 5, AND APPROVING
THE CITY OF BAKERSFIELD AS THE LEAD AGENCY FOR
THE EIR-Tier 1 AND ITS USE FOR THE WESTSlDE
PARKWAY FACILITY.
WHEREAS, the State of California Department of Transportation (herein
Caltrans) prepared a Tier 1 Environmental Impact Report (herein EIR-Tier 1) for the
proposed alignment of State Route 58 from State Route 99 west to Interstate 5; and
WHEREAS, Caltrans prepared and certified the completion of the EIR-Tier
1 in conformance with the requirements of Division 13 of the State of California Public
Resources Code (California Environmental Quality Act, or herein CEQA); and
WHEREAS, this proposed alignment of State Route 58 is coincident with the
alignment of the Westside Parkway facility which is proposed to be designed and
constructed by the City of Bakersfield (herein CITY)using a mix of State and Federal funds;
and
WHEREAS, Caltrans who administers these State and Federal funds,
requires the jurisdiction applying for these funds for a project to also be the jurisdiction
listed as the lead agency for the CEQA environmental document for the project; and
NOW, THEREFORE be it resolved by the Council of the City of Bakersfield
as follows:
That the EIR-Tier 1 prepared and certified by Caltrans for the
construction of State Route 58 from State Route 99 to Interstate 5
was done in accordance with the requirements of CEQA.
That the City of Bakersfield adopts the EIR-Tier 1 as the lead agency
for the subsequent acquisition of right of way for the Westside
Parkway.
That a copy of this resolution be transmitted to Caltrans in conjunction
with filing of applications for the various funding requests for
acquisition of right of way for the Westside Parkway, and that Caltrans
be requested to concur in these findings and process the application
and allocation of funds as specified in the City's application.
I HEREBY CERTIFY that the foregoing Resolution was passed and adopted by the
City Council of the City of Bakersfield at a regular meeting thereof held on
