A RESOLUTION AUTHORIZING THE ESTABLISHMENT OF
A SPECIAL ASSESSMENT FUND TO COLLECT
DELINQUENT REFUSE CHARGES BY THE KERN COUNTY
TAX COLLECTOR.
WHEREAS, Chapter 8.32 of the Bakersfield Municipal Code authorizes the
establishment and increase of fees and charges to recover costs for services rendered;
and
WHEREAS, pursuant to article XIIID of the California Constitution
(Proposition 218), notices of the proposed rate and adjustment and public hearings on said
adjustment were mailed to owners of record of all residential property in the City of
Bakersfield; and
WHEREAS, a public hearing was held to determine whether the proposed
fees and charges are discriminatory or excessive; and
WHEREAS, Section 8.32.060 (B) of the Bakersfield Municipal Code provides
for the prorated billing of new residential refuse service for single family dwellings,
duplexes, triplexes and fourplexes prior to placing these charges on the County Property
Tax Bill; and
WHEREAS, the City of Bakersfield has directly billed new residential
customers the appropriate prorated amounts and has been unable to collect on certain
delinquent accounts.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
Bakersfield as follows:
The Council of the City of Bakersfield hereby authorizes the Kern County Tax
Collector to establish a special assessment fund for the collection of delinquent prorated
new services for single-family dwellings, duplexes, triplexes, fourplexes and the multi-family
units to be billed at the time of billing of property taxes.

Council of the City of Bakersfield at a regular meeting thereof held on
