PUBLIC HEARINGS - Tentative Tract Maps
5.1) Vestinq Tentative Tract Map 6104 (Mclntosh & Associates) (Ward 3)
Staff report given recommending approval of the request for reverse corner lots and
denial of the applicant's request to allow intersections that do not meet the minimum
separation distance. Staff recommended approval of the subdivision subject to the
conditions of approval contained in the staff report.
Commissioner Tragish asked if they are talking about each one of the major
intersections surrounding the project? Mr. Grady said "no." Ms. Shaw said they are
interior streets and would tell him on Thursday which ones. Commissioner Tragish
asked what the minimum separation is as required and what is proposed? Ms. Shaw
said she would have the answer to that on Thursday.
Commissioner Gay asked if there is a sound issue regarding the water well sites? Mr.
Grady said it is his understanding that they are well insulated. They are in a pump
house. Mr. Grady said he could have someone in the Water Department explain more
fully. Commissioner Gay said just an explanation would be enough.
Commissioner Sprague asked how deep the 18-inch water cement pipeline is buried that
is mentioned on Page 2 of the staff report and whether or not it will be removed during
construction of the subdivision? Should it be disclosed by the seller to a buyer that there
is an abandoned pipeline in the ground? Mr. Grady said the staff report says that the
applicant's engineer indicates that the irrigation pipe will be rerouted along Mountain
Vista Drive and Panama outside the buildable area of the map. Commissioner Sprague
asked if the old line will be removed? Mr. Grady said they would get that information by
Thursday.
Commissioner Sprague asked what the code says about bike lane widths? Ms. Shaw
said if there is curb and gutter it is four feet. If not, it is six feet.
Commissioner Sprague asked about item 30 and wondered if the block wall would be
extended to 8 feet between the commercial and residential property? Mr. Grady said the
requirement is 6 feet.
Commissioner Tragish asked if the abandoned well on Lot 64 Phase B will be capped
off? Mr. Grady said the well will be capped according to Department of Oil and Gas and
Geothermal Resources requirements. It will not be fenced and there will be no indication
above ground of its location. Commissioner Tragish asked if it is a requirement to have
some type of indication on the lot that is going to be occupied that there is an abandoned
well on their property? Condition 33.b states that a deed restriction be recorded
specifying the exact location of each well and prohibits construction of a structure within
ten (10) feet of the well.

Vestinq Tentative Tract Map 6108 (Porter-Robertson) (Ward 4 )
Staff report given recommending approval with conditions contained in the staff report.
Commissioner Gay asked if they could have a map that zooms out that shows the next
intersection down and part of the shopping center? Also, if Dove Creek is going to be a
full left-right intersection or are they going to traverse through the residential
neighborhood to get out to a left-right intersection? Also, during the week he would like
to talk to staff about parking requirements for four-plexes.
Commissioner Tragish asked if there is going to be a traffic light in the foreseeable
future on the corner of Palm Avenue and Allen Road? Commissioner Tragish also
wanted to know what the proposed vehicle trips are anticipated to be in and out of the
project and what are the anticipated vehicle trips in and out of the residential
neighborhood next to it? Commissioner Tragish asked if there are any school bus stops
anywhere near the project?
Commissioner Tragish said he is concerned about the only access to the project being
through the residential neighborhood and is concerned about Dove Creek becoming a
very heavily traveled street with the two areas converging onto Allen Road.
Staff will have a response to Commissioner Tragish's questions on Thursday night.
Commissioner Sprague said that there is a request for this item to be placed on the
Consent Agenda for Thursday but because of the questions already asked and the ones
he will ask, he thinks it should be left off of the Consent Agenda.
Commissioner Sprague asked if the applicant has acquired permission from the
commercial property owner for the secondary access? Commissioner Sprague asked if
this meets with the general plan as far as high density residential in an area of estate,
agricultural and C-2 zoning that surrounds this property? He requested staff inform the
Commission if any more calls come in regarding the high density. He is also concerned
about the parking and asked what the parking requirement is for this many four-plexes in
one area with just one cul-de-sac street? Commissioner Sprague asked if all the cars
are required to be parked on-site adjacent to the apartments or are they allowed parking
on the street? Mr. Grady said they are required to provide on-site parking but they are
not prohibited from parking on the street unless the street is posted for no parking.
Commissioner McGinnis asked if there are any plans for signalization on Majesty Palms
Street and Dove Creek? Mr. Grady said it was discussed briefly at a meeting but that
there are no plans for a signal on Dove Creek. The roadway is a county road and the
property is subject to an annexation. When the property is annexed half of the street will
be in the city.
Commissioner Blockley asked what kind of access control would there be between the
Albertson's supermarket and the end of the cul-de-sac? Mr. Grady said typically there
would be a wall.

Vestinq Tentative Tract Map 6019 (Porter-Robertson) (Ward 4)
Staff report given recommending approval with conditions attached to the staff report
and as amended by the memorandum from Public Works the Commission received this
afternoon. The applicant has requested this be put on the Consent Agenda for
Thursday.
Commissioner Tragish had a question about a pipe that he observed sticking up out of
the ground at the site. He asked Mr. Grady to see what he could find out about it.
Commissioner Sprague asked, regarding the request to eliminate the sidewalks, if in the
past haven't they at least required sidewalks on one side of the street? Ms. Shaw said
that she can remember several private tracts where they have required sidewalks on at
least one side of the street at a minimum. Commissioner Sprague said that it is his
personal preference to require sidewalks on at least one side of the street.
Commissioner Sprague asked what the reason is for the 20 foot setback instead of a 25
foot setback? Mr. Grady said it is provided in the RiverLakes Ranch Specific Plan if they
back up to the golf course or lake.
Commissioner Sprague said that he has had a lot of people talking to him about the roll
top curbs and wondered if the city prefers them or are they cheaper to build? Ms. Shaw
said the city's preferred standard is the 6 inch style curb, however, they do allow rolled
curbs in certain locations, private tracts being one of them. It is not a preference that the
city has, the developer requests this specifically. Commissioner Sprague asked if most
of the curbs in the RiverLakes area are rolled? Ms. Shaw said she would let him know
on Thursday.
Commissioner Sprague asked if Lot B is a common lot or will there be a house on it?
Mr. Grady said yes it is a common lot and it will be maintained by a maintenance district.
Commissioner Sprague asked about boat and RV parking and if staff could look at the
CC&Rs to see if they were allowed? Mr. Grady asked if he had a condition in mind to
place on the map that would lead up to that if staff finds out it is not a part of the
CC&R's? Commissioner Sprague said yes, a condition that would prevent RV, boat and
junk cars in the designated spots within the subdivision. Ms. Gennaro said that typically
that is in the CC&Rs and she is reluctant for the Commission to impose a condition of
that sort because sometimes the developer builds with that mind.
Commissioner Blockley asked under Public Works comment 1.2 on Exhibit 1 if staff is
recommending sidewalks on one side or both sides of this development? Ms. Shaw said
it is to deny the request and require sidewalks on both sides, however, they include a
backup proposal if they wish to pursue it.
Commissioner McGinnis asked if rolled curbs are permitted in the city when they are
publically maintained? Ms. Shaw said generally speaking only in certain cases such as

mobilehome parks. They are not usually allowed on public maintained streets.

Staff report given recommending approval with conditions attached to the staff report.
Commissioner Gay asked if the applicant is requesting Type B rolled curbs? Ms. Shaw
said they show standard curbs.

6. PUBLIC HEARING - VESTING TENTATIVE TRACT MAP 6107 AND ZONE CHANGE NO. 02-
0308 (Porter-Robertson) . (Ward 4)
Staff report given recommending approval of the tract map and zone change with conditions
attached to the staff report and the amended conditions contained in the memorandum received
by the Commission today from the Planning Director. Applicant has requested this item be
placed on the Consent Agenda for Thursday night.
Commissioner Gay asked if this is less than a 60 foot wide street? Question will be answered on
Thursday.
There were no other Commission comments. Item was continued until Thursday night.
GENERAL PLAN AMENDMENT NO. 01-1025 (City of Bakersfield) (Wards 1 & 2)
Ms. Shaw gave a staff report. She stated the Commission has asked for a specific
recommendation from the Public Works Department regarding how far to take a collector
designation on Brundage Lane. She prepared and passed out to the Commission a memo with
some photographs attached showing what and why. They recommend that it be called collector
status and get the additional right-of-way as necessary to get the appropriate transitions.
Commissioner Blockley asked what percentage of traffic on Highway 58 is actually coming off of
Brundage? Ms. Shaw said the proximity of Brundage to 58 is one of the reasons that they
recommended Brundage be downgraded. She did not have traffic numbers regarding the
number of cars that use 58 instead of Brundage.
Commissioner Gay asked if Union Avenue, Business Route 99, still part of the circulation plan?
Ms. Shaw said she does not think Union is part of the plan anymore but would check and let him
know on Thursday.
Commissioner Tragish asked for a clarification on the paragraph in the memo relating to
Lakeview and Mt. Vernon which states: "staff recommends that this portion also be changed to
collector status with the caveat that portions of the roadway would have to be dedicated and
constructed at a wider standard to provide ..." Commissioner Tragish asked if that means the
north side has to be widened to be compatible as a collector? Ms. Shaw said the south side of
Brundage Lane between Lakeview and Mt. Vernon has been almost entirely developed. There
are a couple of small pieces that have not been developed. Those will be the areas that we will

need additional right-of-way beyond the standard collector width.
Commissioner Tragish asked if the properties between Mt. Vernon and Oswell are a majority of
undeveloped land? Ms. Shaw said most of them are larger lots and undeveloped.
Commissioner Sprague asked if the city has any idea how many property owners have
developed to arterial standards on Brundage up to now? Ms. Shaw will have the answer on
Thursday.

Verbal - Mr. Joseph A. Austin, with the Department of Oil and Gas, asked if the
Commission was in receipt of their letter dated April 18, 2002, regarding Tract 61047
The letter was addressed to Ms. Palmer and the Planning Commission. Commissioner
Sprague said he was not aware of the letter. Mr. Austin then passed out a copy of the
letter to the Commission. Commissioner Sprague told Mr. Austin that Tract 6104 will be
before the Commission on Thursday and he may come and speak at that time.
