A RESOLUTION DETERMINING THAT CERTAIN
E.J. WARD, INC. AUTOMATED FUELING
SYSTEMS, PARTS AND SERVICES CANNOT BE
REASONABLY OBTAINED THROUGH THE USUAL
BIDDING PROCEDURES AND AUTHORIZING THE
FINANCE DIRECTOR TO DISPENSE WITH
BIDDING THEREFORE AND PURCHASE E.J.
WARD, INC. AUTOMATED FUELING SYSTEMS,
PARTS AND SERVICES FROM E.J. WARD, INC.,
NOT TO EXCEED $70,000.
WHEREAS, CITY is in need of new and replacement automated fueling
systems, parts and services; and
WHEREAS, City currently has E.J. Ward, Inc. automated fueling systems in
service in applicable fleet equipment since the original installation of the
automated fueling systems; and
WHEREAS, City currently has 20 fueling terminals located through the City and
approximately 1,100 fueling transmitters in equipment that are not interchangeable
with any other system or fueling software; and
WHEREAS, E.J. Ward, Inc. automated fueling systems can only be acquired
through the manufacturer, E.J. Ward, Inc., and
WHEREAS, it is necessary to purchase E.J. Ward, Inc. automated fueling
systems because of the necessity to successfully integrate such equipment into the
existing City automated fueling system.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as
follows:
1. The above recitals are true and correct and incorporated herein by
reference.
2. As the sole distributor and service provider, the work and equipment
can only be reasonably obtained from one vendor, E.J. Ward, Inc., because of the
need to successfully integrate such equipment into an existing City system.
3. The Finance Director is authorized to dispense with bidding in
accordance with Section 3.20.060 of the Bakersfield Municipal Code.
4. The expenditure of funds for said work and equipment shall not exceed ,NKF

Seventy Thousand Dollars ($70,000). r

Dear Sir /Madam:
For more than 40 years EJ Ward Inc. has developed the most advanced fuel management
technology and became a leading fleet asset management solutions provider. Ward's solutions
offer a new level of product reliability, technical support, and integrated systems unmatched in
today's industry. This comprehensive expertise will be leveraged in providing the City of Long
Beach with the most innovative and advanced fuel management technology available.
EJ Ward Inc. (Ward) is the original equipment manufacturer (OEM) of the Fuel View software and
its related components known as the Ward Automated Fuel Management System (AFMS') and
the exclusive provider of the Fleet View Asset Tracking System (ATS' ).
EJ Ward, Inc. owns the intellectual property rights to its Automated Fuel Management System
(AFMS), Telematics GPS /AVL solution, Related Software Programs, Communication Systems
and Documentation.
E.J. Ward, Inc. is the sole supplier and support agent direct or through its authorized agents of its
software, fuel control terminals and all related components, including but not limited to mother
boards, Single board computers, communication interfaces, pump controllers, firmware and
related software programs and documentation utilized in the Automated Fuel Management
System (AFMS), and Telematics GPS /AVL solutions.
At this time, Ward has not certified any other fuel management technology, vehicle installed
devices or global positioning system's (GPS) tracking devices other than those offered
directly by Ward to be installed in conjunction with or plugged into the vehicle Engine Control
Module (ECM) port (e.g. OBD II etc.) in parallel with the Ward Canceiver -. Only the Ward
supplied devices are certified to operate simultaneously with the Ward fuel management system
or its Canceiver" while plugged into the vehicle ECM. Installing non-certified devices may affect
operations of the Ward AFMS, the CanceiverTM, as well as possible vehicle functionality.
