HomeMy WebLinkAboutRES NO 114-02RESOLUTION NO. I I 4 - 0 2 A RESOLUTION PROVIDING FOR THE PRESERVATION OF CITY LIENHOLD INTERESTS IN TAX DEFAULTED PROPERTIES TO BE SOLD BY THE COUNTY OF KERN. WHEREAS, the County of Kern, Treasurer and Tax Collector, has notified the City of Bakersfield that it will offer for sale at public auction to the highest bidder certain properties upon which the City maintains liens for demolition and/or weed abatement; and WHEREAS, pursuant to Revenue and Taxation Code section 3695, the City may, before the date of sale, file with the Tax Collector and the Board of Supervisors certified copies of a resolution adopted by the City Council objecting to the sale; and WHEREAS, the City's objection shall preserve the City's lien interest in the property, provided that the City agrees to purchase the properties; and WHEREAS, the City does not desire to purchase any of the properties, however, Revenue and Taxation Code section 3791.3 authorizes redevelopment agencies to purchase such properties; and WHEREAS, the Bakersfield Redevelopment Agency desires to purchase three (3) properties located within the Southeast Bakersfield Redevelopment Project Area. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Bakersfield as follows: 1. The City Council of the City of Bakersfield does hereby object to the proposed sale of the enumerated tax-defaulted properties by the County of Kern, Treasurer and Tax Collector. 2. Pursuant to Revenue and Taxation Code section 3695, the City of Bakersfield does hereby intend to preserve lienhold interest from the public auction sale of the enumerated tax-defaulted properties: (a) Assessor's Parcel No. 018-230-20-00-4; (b) Assessor's Parcel No. 018-320-03-00-1; (c) Assessor's Parcel No. 019-183-07-00-1; The City Council hereby directs the City Clerk to record in the Office of the County Recorder a true and correct copy of this Resolution and to forward certified copies of the Resolution to the Kern County Tax Collector and Board of Supervisors. 4. The City Council will direct the Bakersfield Redevelopment Agency to submit a proposed agreement to purchase the properties to the County as soon as possible.
