RESOLUTION NO. 12 a - 15
A RESOLUTION OF THE COUNCIL ORDERING THE VACATION OF
THE ALLEY BETWEEN V STREET AND UNION AVENUE, BETWEEN
201H STREET AND 21ST STREET WITHIN BLOCK 218 AND 219 OF
GODEY TRACT (WARD 2)
WHEREAS, on WEDNESDAY, September 2, 2015, the Council of the City of Bakersfield,
pursuant to the provisions of the "Public Streets, Highways and Service Easements
Vacation Law," Government Code Sections 8300 et seq. of the Streets and Highways
Code of the State of California, passed and adopted Resolution of Intention No. 1846
declaring its intention to vacate the alley east of V Street, to Union Avenue, between
20th Street and 21 It Street within Block 218 and 219 of Godey Tract (Ward 2); and
WHEREAS, the Council did fix a time and place for hearing all persons interested
in or objecting to said proposed vacation, which hearing was held on September 16,
2015, after notices of said hearing were duly published and posted as required by law;
and
WHEREAS, for the above- described project, it was determined that the proposed
vacation is exempt from CEQA, pursuant to Section 15061 (b) (3) of CEQA Guidelines
(General Rule) in that there is no possibility that the proposed action could have a
significant effect on the environment; and
WHEREAS, on June 17, 2015, Planning Department found the vacation to be
consistent with the Metropolitan Bakersfield General Plan, per local ordinance.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Bakersfield as
follows:
1. The above recitals are true and correct and are incorporated herein.
2. This Resolution is adopted pursuant to Section 8300, et seq. of the Streets and
Highways Code of the State of California.
3. A public utilities easement will be reserved with this resolution, see Exhibit "A" and
Exhibit "B ".
4. The Council orders the vacation of the alley east of V Street, to Union Avenue,
between 20"' Street and 211t Street within Block 218 and 219 of Gooey Tract,
(more specifically described Exhibit "A" and illustrated in Exhibit "B ", which is
attached hereto and incorporated herein), all in the City of Bakersfield, County
of Kem, State of California.

EXHIBIT "A"
That portion of Block 218 and 219 of the Godey Tract of the City of Bakersfield
per map filed October 31, 1892 in the office of the Kern County Recorded, also
being a portion of the Northeast quarter of Section 30, Township 29 South,
Range 28 East, Mount Diablo Base and Meridian, in the City of Bakersfield,
County of Kern, State of California, more particularly described as follows:
The entire 33 -foot wide alley of said Block 218 and 219, bounded on the West
by the Easterly right of way line of "V" Street and on the East by the Westerly
right of way line of Union Avenue (also known as Golden State Avenue).
RESERVING a nonexclusive easement and right of way for public utilities, to lay,
construct, operate, maintain, repair, reconstruct, change the size of or remove
pipelines, conduits, cable, wires, poles or any other structures, fixtures or
equipment, in, under, across, over and upon the 33 -foot wide alley of said Block
218 and 219 as described above.
Containing approximately 14,935 square feet.
