SUBJECT: General information
1. The storm activity last weekend brought a couple of inches of rainfall tc
watershed. With median precipitation until April, we should end up at 100°r
for the year. At the minimum we will be in the 70% range if there is nc
storm activity. Either way we should be able to meet all contract commitm
little to spare. The high end may let some water down the river this summE
keeping our fingers crossed.
2. We have seen a drop in the number of fatal accidents that occurred on city
2007 there were 20 fatal traffic accidents, down from 33 in 2006. The
vehicles versus pedestrian fatal accidents also dropped from 12 in 2006 to
These reductions are largely attributed to increased enforcement efforts by
Department Traffic Section.
3. The Recreation and Parks Department will receive a$20,000 reimbursei
from First 5 Kern for playground resurfacing at five different playgrounds
the city.
4. In partnership with Bike Bakersfield and the Bakersfield Police Department
learning how to repair and fix bicycles at Dr. Martin Luther King Cei
instructor is a volunteer from Bike Bakersfield and he teaches bike safety
bike repair and maintenance. The bicycles are donated through �
Department's Stolen Property room. Children earn a bike to keep
complete the requirements of the class.
5. We continue to make progress on our department relocations. The
Technology Division had been split between City Hall North and South

Councilmember Benham asked that our office respond to your letter dated �
2008 regarding a possible anti-solicitation ordinance.
Distribution of printed matter to homes is governed by Chapter 8.30 in our
Municipal Code. Section 8.30.020 prohibits distribution of unsolicited printed matter t�
property unless it +s delivered in accordance with Section 8.30.030. This section states;
Distribution of unsolicited printed matter upon residential property is
not prohibited by Section 8.30.020 if the printed matter is placed
within the outer (screen or storm) door of any residence, enclosed in
a transparent plastic sleeve and attached to the handle of such door,
or printed matter fastened over the doorknob of such outer door,
without knocking or ringing the door bell or if the printed matter is
handed to a resident of the property. Nothing contained in Section
8.30.020 shall apply to limited status mail carriers in the discharge of
their duties.
While many residents are understandably annoyed and bothered by the
advertising, pamphlets, brochures and so on that they receive on their doorsteps, the i
places limits on what cities can do to address this annoyance through government

Councilmember Couch requested staff look into the feasibility of a property c
tax base being transferred to a new property in the event they are displaced
freeway alignment and/or eminent domain.
California law already provides that under certain conditions a perso
transfer the base year value of his or her property to a comparable replac
property if the original property has been taken by eminent domain procee
acquisition by a public entity, or governmental action resulting in a judgment of ii
condemnation (Article XIII A, California Constitution and Revenue and Taxatior
§ 68). A person who wishes to transfer the base value of his or her property to a
property can submit a form (entitled "Claim for Base Year Value Transfer—Acq�
by Public Entit�') with appropriate documentation to the Assessor's officE
attached). In addition, the claim must be reviewed and approved by the Bc
Equalization in Sacramento.

GENERAL INFORAAATION
Califomia law provides that under certain conditions a person may transfer the base year value of his or hE
comparable replacement property if that original property has been taken by eminent domain proceedings, acqui;
entity, or govemmental action resulting in a judgment of inverse condemnation.
To be considered comparable, a replacement property acquired by a person displaced under one of the three G
must be similar in size, utility, and function to the taken property. Replacement property is similar in size if its
does not exceed 120 percent of the award or purchase price paid for the property taken. Replacement propE
utility and function if it is, or is intended to be, used in the same manner as the property taken. Property is simi
function if the property taken and the replacement property fall into the same category: Category A- single fan
Category B- commeraal, investment, income, or vacant property; Category C- agricultural property. If replacer
not similar in size, function, and utility, the excess portion is considered to have undergone a change in owner
subject to reappraisal.
The base year vafue of the replacement property will be determined by comparing the award or purchase price p�
property with the full cash value of the replacement property:
• If this value does not exceed 120 percent of the award or purchase price paid for the taken propert
the adjusted base year value of the taken property becomes the replacement property's base year �
• If the fult cash value of the replacement property exceeds the 120 percent level, the amount of full cash
in excess of 120 percent will be added to the base year value of the taken property. This sum becom
base year value of the replacement property.
• If the full cash value of the replacement property is less than the base year value of the property take
lower value becomes the base year value of the replacement property.
• If there is no award or price paid for the property taken (i.e., an exchange), the Assessor must dete
the full cash value of both the property taken and the replacement property.
Only the owner(s) of the property taken may receive this property tax relief. Owner means the fee owner or life E
the real property taken.
For replacement property acquired on or after January 1, 1983, a �equest for relief is considered timely if made
of one of the %Ilowing dates, whichever is applicable:
• The date the final order of condemnation is recorded or the taxpayer vacates the replaced prc
whichever is later.
• The date of the conveyance or the date the taxpayer vacates the replaced property, whichever is lat�
• The date the judgment of inverse condemnation becomes final or the date the taxpayer vacates the re�
property, whichever is later.
Replacement property is eligible for relief if acquired after March 1, 1975, and on or after the earliest of:
• The date the initial written offer is made by the acquiring entity.
• The date the acquiring entity takes final action to approve a project leading to the offer.
• The date the °Notice of Determination," "Notice of Exemption," or similar notice, as required by the Cali
Environmental Quality Act (CEQA), is recorded by the public entity acquiring the taxpayer's propert

• The date, as declared by the court, that the replaced property was taken.
Any new construction required to make the replacement property oomparable to the taken property will be eligible f�
tax relief, if the new construction is completed after March 1, 1975, is completed on or after the earliest of the fc
