AN ORDINANCE AMENDING TITLE SEVENTEEN OF
THE BAKERSFIELD MUNICIPAL CODE AND ZONING
MAP 102-31 BY CHANGING THE ZONING OF 20.30
ACRES GENERALLY LOCATED BETWEEN THE
PROPOSED KERN RIVER FREEWAY, CROSS VALLEY
CANAL AND THE ADOPTED CALLOWAY DRIVE
ALIGNMENT FROM AGRICULTURE, 20-ACRE
MINIMUM LOT SIZE TO PLANNED UNIT
DEVELOPMENT.
WHEREAS, in accordance with the procedure set forth in the provisions of
Title 17 of the Municipal Code of the City of Bakersfield, the Planning Commission held
a public hearing on a petition to change the land use zoning of those certain properties
in the City of Bakersfield generally located between the proposed Kern River Freeway,
Cross Valley Canal and adopted Calloway Drive alignment; and
WHEREAS, by Resolution No. 46-95 on June 15, 1995, the Planning
Commission recommended approval and adoption of an ordinance amending Title 17 of
the Municipal Code to approve a zone change from Agriculture, 20-acre minimum lot
size to Planned Unite Development as delineated on attached Zoning Map No. 102-31
marked Exhibit "B", by this Council and this Council has fully considered the
recommendations made by the Planning Commission as set forth in that Resolution; and
WHEREAS, the Planning Commission, as a result of said hearing, did
make several general and specific findings of fact which warranted a negative declaration
of environmental impact and changes in zoning of the subject property from Agriculture,
20-acre minimum lot size to Planned Unit Development and the Council has considered
said findings and all appear to be true and correct; and
WHEREAS, the law and regulations relating to the preparation and
adoption of Negative Declarations, as set forth in CEQA and City of Bakersfield's
CEQA Implementation Procedures, have been duly followed by city staff, Planning
Commission and this Council; and
WHEREAS, a Negative Declaration was advertised and posted on April 28,
1995, in accordance with CEQA; and
WHEREAS, the general plan designation for this area allows urban type
development; and
WHEREAS, the City Council has considered and hereby makes the
following findings:
1. All required notices have been given.
2. The provisions of the California Environmental Quality Act
(CEQA) have been followed.

The proposed project will not have a significant effect on the
environment.
4. The public necessity and general welfare justify the change of the
zoning district to Planned Unit Development.
5. The public necessity and general welfare justify the elderly care
assisted and independent living facility.
6. The proposed amendment of the Zoning Ordinance is compatible
with existing zoning districts adjacent to the subject site.
7. The elderly care assisted and independent living facility is
compatible with land uses adjacent to the subject site.
8. Elements of the Metropolitan Bakersfield 2010 General Plan do not
show any equestrian trails in the general area of the subject site north of the Cross
Valley Canal.
9. The Planned Unit Development site plan does not show or indicate
how equestrian trails will connect with the equestrian access shown on the site plan.
10. Any equestrian trail located adjacent to a freeway may create an
equestrian safety problem.
11. The subject site was annexed to the city as A-20A (Agricultural-20
acre minimum lot size) and is still zoned A-20A which is consistent with the Open Space
designation of both the previous general plan and the existing Metropolitan Bakersfield
2010 General Plan.
12. The proposed Kern River Freeway alignment, the adopted Calloway
Drive alignment and the Cross Valley Canal create a relatively isolated parcel which
would be difficult to maintain in agriculture production.
13. The Assisted Living Facility is incidental to and compatible with the
Independent Living Facility.
14. The applicant intends to start construction within two and one-half
years from effective date of the zoning change.

SECTION 1.
NOW, THEREFORE, BE IT ORDAINED by the Council of the City of
Bakersfield as follows:
1. All of the foregoing recitals are hereby found to be true and
correct.
2. The Negative Declaration is hereby approved and adopted.
3. Section 17.06.020 (Zoning Map) of the Municipal Code of the City
of Bakersfield be and the same is hereby amended by changing the land use zoning of
that certain property in said City, the boundaries of which property is shown on Zoning
Map No. 102-31 marked Exhibit "B" attached hereto and made a part hereof, and are
more specifically described in attached Exhibit "C".
4. Such zone change is hereby made subject to the conditions of
approval listed in attached Exhibit "A", subject to approval of GPA 2-95, Segment IV.
SECTION 2.
This ordinance shall be posted in accordance with provisions of the
Bakersfield Municipal Code and shall become effective thirty (30) days from and after
the date of its passage.

Conditions of Approval
Zone Change No. 5632
Plannin~ Department:
A split-face masonry wall, six feet in height, shall be constructed along the subject site's north, east
and west property lines as per the location shown on Figure I.
A wrought iron fence or wrought iron/masonry fence combination, six feet in height, shall be
constructed along the subject site's west property line as per the location shown on Figure I.
A chain link fence, six feet in height, shah be constructed along the subject site's southerly
property line as per the location shown on Figure I.
A landscaping strip consisting of evergreen trees and evergreen tree-llke shrubs shah be planted
along the entire length of chain link fence within the subject site. Evergreen trees should have a
maximum height of 25 to 35 feet and be planted 30 to 35 feet on center. Evergreen trees shall be
a minimum size of 24 inch box tree. Evergreen tree-like shrubs should be a maximum of 10 feet
high and planted 10 to 15 feet on center. Tree-like shrubs shall be a minimum size of 15 gaflon.
Trees and tree-like shrubs should have bubbler head irrigation and be planted at such a distance
from the canal to prevent roots from impacting the conerote lined wall of the canal.
Entryway monuments shall be constructed along both sides of the two Calloway Drive
ingress/egress drives.
Site Plan Review Conditions:
~A* CONDITIONS: This category contains conditions that require specific alterations to your plans.
These changes must be reflected on the plans required by the Building Department for plan check. T/w
Building Department will not begin plan ch~ck until all "Am Conditions are correctly indicated on the plat~
submitted for plan check.
Designate a fire lane, pursuant to City requirements, as shown on the attached site plan. Please
indicate spacing between signs that meet City standards. (Fire)
7. Post red curb and signs on both sides of street around entire complex. (Fire)
8. Indicate on the final plan all on-site fire hydrant locations and required fire flows. (Fire)
Parking lot lighting shah be provided pursuant to Section 17.58.060 A of the Municipal Code.
Lights shall be designed, arranged, and shielded to reflect away from adjacent residential
properties and streets with illumination evenly distributed across the parking area. All light
fixtures shall be located between 15' and 40' above grade. Lighting direction and light fixtures

The applicant shall construct on-site paving with a minimum of 2" Type B, A.C. over 3" Class II

The tunnel shown on the site plan, if constructed, shall be constructed by the applicant prior to
the construction of Calloway Drive. The City currently has a contract to construct Calloway
Drive, and any changes to the City contract caused by this tunnel construction shall be paid for
entirely by the project applicant upon demand by the City. Otherwise, the tunnel will not be
allowed. The tunnel shall be installed through an encroachment permit issued by the City which
shah state that the tunnel shah be maintained by the project applicant. The permit shah be
revoked and the tunnel closed if proper maintenance is not performed. Tunnel plans shah be

A comprehensive drainage plan (as per Condition No. 3 of GPA 2-95, Segment IV) shah be
submitted for review and approval by the City Engineer prior to plans submitted to Building

(Fire Prevention Bureau) for fire and safety requirements and provide one (1) set of building
plans showing the required plan corrections to Fire Safety Control (Fire Marshal, (805) 326-3951
prior to the final site plan being approved. (Fire)

In order to provide adequate fire protection during construction, the applicant shall install 12 fire
hydrant(s) as shown on the attached plans or provide alternative fire suppression as approved by
the Fire Department prior to final site plan approval. (Fire)

The applicant shall provide four copies of the grading plans and two copies of the preliminary

"C" CONDITIONS: This category consists of informational notes that might be helpful to you. It also

with each of these conditions is specified in the condition.

All streets and access roads to and around any building under construction must be at least 20
feet of unobstructed width and graded to prevent pondtrig at all times. Barricades must be placed
where ditches and barriers exist in roadways. Emergency vehicle access must be reliable at all

32. Based upon available information, the fire flow requirement may be 3,500 gallons per minute.
All persons required to furnish fire hydrants are hereby required to purchase the required fire

NOTICE - Habitat Conservation fees for this project will be calculated based on the fee in effect
at the time (currently $1,240 per gross acre) payable to the Planning Department prior to issuance

Implementation/Management Agreement ( Section 2.21) for the Metropolitan Bakersfield Habitat
Conservation Plan. Upon payment of fees, the applicant will receive acknowledgement of
compliance with Metropolitan Bakersfield Itabitat Conservation Plan

Prior to building occupancy, sub-standard off-site improvements shall be reconstructed to city
standard or repaired as directed by the City Engineer. Please contact the construction

The developer shall be responsible for providing all labor and materials to energize all street lights
adjacent to the site. All street lights SHALL BE energized prior to occupancy. (Engineering

A sewer connection fee shall be paid prior to issuance of a building permit. The fee will be based
on the current adopted charges at the time of issuance of the building permit. (Engineering

A transportation impact fee for regional facilities shall be paid at the rate in effect at the time of
issuance of a building permit. The rate per vehicular trip varies according to the project type and
size. Bemuse of the mixed use nature of this project, the rate per vehicular trip wouM vary for

A permit from the Public Works Department is required prior to any work within city right-of-way
(street, alley, easement). A copy of the approved site plan with conditions shall be submitted to

The traffic study and resulting impacts identified in items 59., 60., 61., and 62. above are based on
a 250 bed independent living facility and a 300 bed nursing care facility within the zone change
Area, while the land use proposed could allow more or less beds uses as well as other uses. Not
including the proportionate share costs to be determined based on an engineer's estimate (**
items), based on the above project description, the local traffic mitigation yields a unit cost per
nursing care bed of $151.13 and a unit cost per independent living bed of $174.24. These unit
costs per bed plus the proportionate share costs to be determined based on an engineefts estimate
(** items) shall be maintained regardless of the number of beds that are finally developed so that
proportionate traffic mitigation will be achieved. Should an increase of more than 5% in beds be
proposed for any specific project within the GPA area, then a review and possible revision to the
traffic study and resulting revision to local traffic mitigation fees may be required.
The northerly Calloway Drive access point into the development shall be designed to maximize the
spacing between it and the Kern River Freeway interchange and shall align with the access point
from the project to the west. The design shall be done in consultation with CalTrans and shall be
subject to final approval by the City Engineer. The southerly access point shall be gated and shall
be for emergency. access only.
The traffic study projects left-turns south on Calloway Drive out of the development. For this full
access, a traffic signal is rcquired. This signal shall be installed by the project applicant and be
operational prior to occupancy of any development or residence within the GPA area.

A northbound right-turn deceleration lane shall be constructed by the project applicant at the
Calloway Drive entrance to the project (for the northerly access only).
As the development proposed consists of private streets, all sewer lines and appurtenances (pump
stations, etc.), drainage basins, and storm drainage systems shall be maintained by the homeowners
association established to maintain the streets.
NOTE: * indicates adjustments have been made on these items to account for the Regional
Transportation Impact Fee's contribution towards the item.
